RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING
APPROVAL OF A SIGN VARIANCE
WHEREAS, an application for Variance VN07-6 has been made by City Center
Ventures, LLC; and
WHEREAS, the procedural history of the application is as follows:
1. That an application for Variance VN07-6 was made by City Center
Ventures, LLC on August 28, 2007;
2. That the Hopkins Zoning and Planning Commission, pursuant to mailed
notice, held a meeting on the application and reviewed such application on
September 25, 2007: all persons present were given an opportunity to be
heard;
3. That the written comments and analysis of the City staff were considered;

4. Legal description of the parcel is as follows:
That part of the Northeast Quarter of the Northeast Quarter of Section 23,
Township 117, Range 22, lying South of the center line of State Highway No. 7
and Northeasterly of the northeasterly line of the Minneapolis and St. Louis
Railway Company's right-of-way, Hennepin County, Minnesota.
NOW, THEREFORE, BE IT RESOLVED BY THE ZONING AND PLANNING
COMMISSION OF THE CITY OF HOPKINS, MINNESOTA, that application for Variance
VN07-6 for signs is hereby recommended for approval based on the following Findings of Fact:
1. That the scale of the signage is proportional to the scale of the
building.
2. That larger signs are needed because of the higher speed limit on
Highway 7.
3. That the signs are on the building and setback from the property line
necessitates that the signs are larger.
BASED ON THE FOREGOING FINDINGS OF FACT, the Zoning and Planning Commission
of the City of Hopkins, Minnesota, hereby determines that the literal enforcement of the
maximum size requirement would cause an undue hardship because of circumstances unique to
'� the subject property, that the granting of the requested variance to the extent necessary to
compensate for such hardship is in keeping with the intent of the Hopkins City Code, and that the

sign variance is reasonable. Therefore, application for Variance VN07-6 is recommended for
approval subject to the following condition:
1. That the sign variance is added to the development agreement.
2. That no pylon signs be placed on the site.
3. That any additional monument signs on the site be no more that 12 feet in
height.
