RESOLUTION NO: RZ07-14
RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING
APPROVAL OF A SIGN VARIANCE AT 1320 MAINSTREET
WHEREAS, an application for Variance VN07-4 has been made by Color Sign Systems,
Inc.; and
WHEREAS, the procedural history of the application is as follows:
1. That an application for Variance VN07-4 was made by Color Sign
Systems on June 13, 2007; �
2. That the Hopkins Zoning and Planning Commission, pursuant to mailed
notice, held a meeting on the application and reviewed such application on
July 31, 2007: all persons present were given an opportunity to be heard;
3. That the written comments and analysis of the City staff were considered;
and
� 4. Legal description of the parcel is as follows:
Commencing at the intersection of south line of Excelsior Avenue and the
east line of southwest '/4 of southwest '/4 thence west along said south line
270 feet thence south 350 feet thence east parallel with said south line.
NOW, THEREFORE, BE IT RESOLVED BY THE ZONING AND PLANNING
COMMISSION OF THE CITY OF HOPKINS, MINNESOTA, that application for Variance
VN07-4 for sign variance is hereby recommended for approval based on the following Findings
of Fact:
1. A 12-sguare-foot sign does not allow for a large user to have a sign
that is proportional to the property.
2. The proposed 56-square-foot sign is proportional to the use of a
school.
3. The proposed sign will provide a message board to provide the school
a way to advertise events.
BASED ON THE FOREGOING FINDINGS OF FACT, the Zoning and Planning
Commission of the City of Hopkins, Minnesota, hereby determines that the literal enforcement
of the requirement for a 12-square-foot sign would cause an undue hardship because of
circumstances unique to the subject property, that the granting of the requested variance to the
�" extent necessary to compensate for such hardship is in keeping with the intent of the Hopkins
City Code, and that the sign variance is reasonable.
