RESOLUTION NO: RZ07-12
RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING
APPROVAL OF A VARIANCE FOR A LOT NOT HAVING FRONTAGE ON A PUBLIC
RIGHT-OF-WAY
WHEREAS, an application for Variance VN07-3 has been made by Mike Halley; and
WHEREAS, the procedural history of the application is as follows:
1. That an application for Variance VN07-3 was made by Mike Halley on
May 25, 2007;
2. That the Hopkins Zoning and Planning Commission, pursuant to mailed
notice, held a meeting on the application and reviewed such application on
June 26, 2007: all persons present were given an opportunity to be heard;
3. That the written comments and analysis of the City staff were considered;
and
� 4. Legal description of the parcel is as follows:
Lot 2 Block 1 Oak Ridge Place 2°d Addition
NOW, THEREFORE, BE IT RESOLVED BY THE ZONING AND PLANNING
COMMISSION OF THE CITY OF HOPKINS, MINNESOTA, that application for Variance
VN07-3 not to have frontage on a public right-of-way is hereby recommended for approval
based on the following Findings of Fact:
1. That the City is not required to maintain a public road to the subject parcel.
2. That a private road will service both lots.
3. That the parcel will have a permanent easement to the private road.
BASED ON THE FOREGOING FINDINGS OF FACT, the Zoning and Planning
Commission of the City of Hopkins, Minnesota, hereby determines that the literal enforcement
of the requirement for a lot to have frontage on a public right-of-way would cause an undue
hardship because of circumstances unique to the subject property, that the granting of the
requested variance to the extent necessary to compensate for such hardship is in keeping with the
intent of the Hopkins City Code, that the variance not to have frontage on a public right-of-way
is reasonable.

BE IT FURTHER RESOLVED that application for Variance VN07-3 is hereby
recommended for approval based on the following conditions:
1. That the site plan is approved to construct the condo building.
2. That there is a permanent easement from the lot to the private road.
