08-29-2006 --� ZONING AND PLANNING COMMISSION MINUTES August 29,2006 A regular meeting of the Hopkins Zoning and Planning Commission was held on Tuesday, August 29, 2006, at 7:40 p.m. in the Council Chambers of Hopkins City Hall. Present were Commission Members, Peter Sholtz, Kathy Newcomb, Kyle Skiermont, Jannina Aristy, Bob Hatlestad and Virgil Aarness. Linda Flynn was absent. Also present were City Planner Nancy Anderson and City Attorney Jerry Steiner. CALL TO ORDER Mr. Sholtz called the meeting to order at 7:40 p.m. in the Council Chambers. APPROVAL OF MINUTES Mr. Skiermont moved and Ms. Aristy seconded the motion to approve the minutes of the July 25,2006, regular meeting. The motion was approved unanimously. CASE NO. ZN06-12 INTERIM ORDINANCE—SHADY OAK ROAD � Ms. Anderson reviewed the proposed moratorium area for Shady Oak Road. The public hearing was opened at 7:45 p.m. Jim Mason, the owner of 120 Shady Oak Road, appeared at the meeting asking for more information. Ed Hanlon appeared at the meeting. Mr. Hanlon is the property manager for several properties along Shady Oak Road. Mr. Hanlon was concerned with the future licensing of the businesses. Ms. Aristy moved and Ms. Newcomb seconded a motion to close the public hearing. The motion was approved unanimously. The public hearing was closed at 7:47 p.m. Mr. Aarness moved and Mr. Hatlestad seconded a motion to adopt Resolution RZ06-18, recommending approval of Ordinance 06-973, placing a moratorium on rezoning and subdivisions on properties abutting Shady Oak Road and Mainstreet from Excelsior to Mainstreet. The motion was approved unanimously. CASE NO. VN06-1 VARIANCE 109 - 11TH AVENUE NORTH Ms. Anderson reviewed the applicant's variance request. Ms. Anderson stated that the recommendation is to approve the variance with conditions. Patrick Hanlon, the applicant, and Nate Schroedl, the property owner, appeared before the Commission. The staff had .-� recommended a 15-foot setback on the south side for a proposed home, and Mr. Hanlon asked if the Commission would consider a 10-foot setback. A lesser setback would � allow a wider home on the vacant lot. Jason Wood of 110 - 11�" Avenue North spoke about the character of the block and stated that he would prefer a more wide-open block. The Commission had a considerable discussion about the 15-foot setback and the moving of the garage to the correct setback. Mr. Hatlestad moved and Mr. Aarness seconded a motion to adopt Resolution RZ06-18, recommending approval of a side yard setback variance of 6.7 feet for an existing home. The motion was approved unanimously. DISCUSSION—B-4 ZONING DISTRICT Ms. Anderson and the Commission discussed the uses allowed in the B-4 zoning district. The Commission noted several uses to be added to the district. Ms. Anderson will revise the B-4 district with the added uses and the Commission will review the district next month. ADJOURN Mr. Sholtz moved and Mr. Hatlestad seconded a motion to adjourn the meeting. The motion was approved unanimously.
