May 25, 2004
A regular meeti��g of the Hopkins Zoning and Planning Commission was held on Tuesday, M��y
25, 2004, at 6:30 p.m. in the Council Chambers of Hopkins City Hall.
Present were Commission members Michael Kjos, Jeffrey Paul, Peter S1loltz, Mary Hatcher, ancl
Jannina Aristy. Robert Hatlestad and Kristi Halverson were absent.
Also present was City Planner Nancy Anderson.
CALL TO ORDER
Ms. Hatcher called the meeti�lg to order at 6:30 p.m.
APPROVAI, Or MINUTES
Mr. Sholtz moved and Mr. Paul seconded the motion to approve the minutes of the April 27,
2004, regular meeting. The inotion was approved unanimously.
CASF, NO: ZN04-6 REZONING LUTHER MAINSTREET

Ms. Anderson reviewed the areas and the reason for the overlay zoning.
The p�iblic hearing was opened at 6:35 p.m. Eric Johnson, a property owner to the north of thc:
Luther property, appeared before the Commission. Mr. Johnson asked if the HCRRA properry
would be part of a future development. Mr. Johnson was told that the proposed redevelopment
clid not include HCRRA property. Mr. Paul moved and Mr. Sholtz seconded a motion to closc
the public hearing. T11e public hearing was closed at 6:37 p.m. The motion was approve�l

Ms. Aristy moved and Mr. Sholtz seconded a motion to adopt Resolution RZU-I-I-�.
recommendin� approval of Ordinance 04-923, placing an overlay PUD dist►-ict on the propertics
between Sixth and Eighth Avenlie on the north side of Mainstreet occupied by Hopl<ii�s Honcl�i.
T'he motion was approved unanimously.
CASE NO: 7N04-7 REZONING LUTHER—250 FIFTH AVENUE SOUTH
Ms. Anderson reviewed the reason for the overlay PUD zoning for the fon-ner Knox site.
The p�iblic hearing was opened at 6:55 p.m. Jeff Hagen appeared at the public hcaring. Mr.
Hagen was co��cerned about the pylon sign and whether the sign would be too bri�ht and have a
��egative affect o�� the Town Terrace apartments. Mr. Allison stated they h�ve not detcrmined

the hours the sign would be illuminated. Mr. Sholtz moved and Mr. Paul seconded a motion to
close the public hearing. The public hearing was closed at 6:58 p.m. The motion was approved
�' unaniinously.
Mr. Paul inoved and Mr. Sholtz seconded a motion to approve ResolLition RZ04-15,
recommending approval of Ordinance 04-924, placing a PUD overlay zoning at 250 Fi(th
Avenue South. The motion was approved unanimously.
CASE NO: 7N04-8 COMPREHENSIVE PLAN AMENDMENT — 250 FIFTH AVENU[;
SOUTH
Ms. Anderson stated that a Comprehensive Plai1 text amendinei�t would allow auto sales o�� thc
I'onner ICnox site.
The public hearing was opened at 6:59 p.m. No one appeared at the public hearing for this item.
Mr. Sholtz moved and Ms. Aristy seconded a motion to close the pliblic hearing. The public
hearing was closed at 7:00 p.m. The motion was approved uilanimously.
Mr. Kjos u�oved and Ms. Aristy seconded a motion to adopt Resolution RZ04-16, recoim»e��ding
approval of a Comprehensive Plan Amendment at 250 Fifth Avenue South. The motion was
approved Linanimously.
CASE NO: CUP04-4 CONDITIONAL USE PERMIT - 250 FIFTH AVENUE SOUTH
�� Ms. Anderson reviewed the site plan with the Commission. John Bal<er, Lynn Robson, and Kylc
Alliso�� ap�eared before the Commission. Mr. Baker reviewed the site plan and elevations with
thc Commission. The Co�nmission discussed the access to the site, design of the building, ancl
use of Eighth Avenue by auto transports. The orientation of the building was also discussed by
the Commission.
The public hearing was opened at 7:01 p.m. No one appeared at the public hearing for this item.
Mr. Kjos moved and Mr. Sholtz seconded a motion to close the public hearin�. The public
hearing was closed at 7:02 p.m. The motion was approved tmanimously.
Ms. Aristy moved and Mr. Sholtz seconded a motion to adopt Resolution RZ04-17,
recommending approval of a Conditional Use Pennit to construct a building for auto sales,
service and body repair at 250 Fifth Avenue South. The motion was approved unanimously.
CASE NO: ZCR04-3 CONCEPT REVIEW— HOPKINS HOUSE
Gretchei� Cainp, Mil<e Roess, and Troy Mathwig appeared before the Commission. Ms. Camp
reviewed the site and floor plans witl� the Commission. Ms. Camp stated they are remodelin�
the interior and constr��cting condos. The existing exterior ski» will be removed ai�d is proposed
to be bricl< base with a light skin on the 4`�' through 7`�' floors. Mike Roess reviewed the history
of�how the property was acquired and how it w�s detennined that condos would be the best usc
for this property in the firture. Mr. Roess also stated that it was a good location for all thc

services near the site. Mr. Paul asked if they were starting with a clean slate. Mr. Roess replicd
that the property was purchased from bankruptcy, and all the back financial issues have b�en
�' taken care of. The Coinmission discussed the age range of the residents. They are predicti���
th�it it would be mixed age group; there will be no three-bedroom �mits. The Comn�ission lool<cd
f�ivorably on the proposed redevelopment.
C.�SE NO: VN04-4 FRONT YARD VARIANCE — 109 HOLLY ROAD
Ms. Anderson reviewed the variance request. Diane and Mike McDonnell appeared beforc thc
Commission Mr. McDonnell reviewed the proposed addition with the Commission. Mr.
McDonnell stated that the home to the north of their property has only a ]7-foot fi-ont yar�1
setback. The Commission discussed at great length if there was any hardship for this prope►-ty.
Mr. Paul moved and Mr. Sholtz seconded a motion to adopt Resolution RZ04-18, recommenclin�
denial of a front yard variance at 109 Holly Road. The motion was approved unanimously.

Mr. Pa�il moved and Mr. Sholtz seconded a motion to adjourn the meeting. Thc motion was
