08-26-2003 ZONING AND PLANNING COMMISSION MINUTES � August 26, 2003 A regular meeting of the Hopkins Zoning and Planning Commission was held on Tuesday, August 26, 2003, at 6:30 p.m. in the Council Chambers of Hopkins City Hall. Present were Commission members, Jay Thompson, Jannina Aristy, Robert Hatlestad, Jeffrey Paul, Peter Sholtz, and Kristi Halverson. Commission member Mary Hatcher was absent. Also present were City Planner Nancy Anderson and City Attorney Jerre Miller. CALL TO ORDER Mr. Thompson called the meeting to order at 6:30 p.m. APPROVAL OF MINUTES Mr. Sholtz moved and Ms. Aristy seconded the motion to approve the minutes of the July 29, 2003, regular meeting. The motion was approved unanimously. CASE NO: CUP03-6 CONDITIONAL USE PERMIT—EISENHOWER SIGN Ms. Anderson reviewed the proposed sign with the Commission. Jeffrey Schoenaeck, �-- representing the School District, appeared before the Commission. Mr. Schoenaeck reviewed the proposed sign with the Commission. The public hearing was opened at 7:45 p.m. No one appeared at the public hearing for this item. Ms. Halverson moved and Ms. Aristy seconded a motion to close the public hearing. The public hearing was closed at 7:46 p.m. Ms. Halverson moved and Mr. Sholtz seconded a motion to adopt Resolution RZ03-17, recommending approval of a conditional use permit to construct a monument sign at Eisenhower Community Center. The motion was approved unanimously. CASE NO: CUP03-7 CONDITIONAL USE PERMIT—DENTAL OFFICE Ms. Anderson reviewed the site plan with the Commission. Ms. Anderson noted that this building is in the Downtown Design Overlay District, and the proposed building meets the requirements. Russell Zenk, the architect, appeared before the Commission. Mr. Zenk showed the Commission the interior plans and an exterior elevation. Mr. Zenk also stated that two people showed up for the neighborhood meeting and they were in favor of the building. The public hearing was opened at 7:50 p.m. No one appeared at the public hearing for this item. Mr. Sholtz moved and 1VIr. Paul seconded a motion to close the public hearing. The public � hearing was closed at 7:51 p.m. MINUTES OF THE ZONING AND PLANNING MEETING Page 2 � Ms. Halverson moved and Mr. Sholtz seconded a motion to adopt Resolution RZ03-18, recommending approval of a conditional use permit to construct the dental office. The motion was approved unanimously. CASE NO: VN03-5 VARIANCE 1702 MAINSTREET—GAS STATION Ms. Anderson reviewed the proposed use and the applicant's request for a rear yard setback variance. Todd Beugen, Barry Goldstein, John Kosmos, and Michael Kiefer appeared before the Commission. There was a considerable discussion on the hardship for the granting of the variance. The following are the main points discussed by the applicants: • Neighborhood site • 15-foot setback does not make sense for this site • Unique piece of property • Old building had junk behind it • Site to the west got a variance • Typically there is an alley in the back of lots along Mainstreet, this lot does not have an alley • Site is unique because of its limited accessibility • Corner has auto- related function to it • Need three gas pumps to make it work • Had market study done, and corner would work for neighborhood convenience store � • Cannot reduce building � Gas station will complement use of the building to the south Mr. Thompson spoke about the use of the site, and said if it were another use it would not need a variance. The Commission asked the applicant if he had thought of another use. The response was that they are not in any other business. Sam Bell, the owner of the building to the west, appeared before the Commission. Mr. Bell was in favor of the variance. Mr. Hatlestad arrived at 7:25 p.m. The Commission continued to discuss the use of the site. Mr. Thompson moved and Ms. Halverson seconded a motion to adopt Resolution RZ03-20, recommending denial of a 14-foot variance. The motion was approved on a 3-2 vote. Mr. Paul and Mr. Sholtz voted nay. Mr. Hatlestad abstained because he came late and was not present for all of the discussion. CASE NO: CUP03-8 CONDITIONAL USE PERMIT — 1702 MAINSTREET GAS � STATION MINUTES OF THE ZONING AND PLANNING MEETING Page 3 �- Ms. Anderson briefly reviewed the request because the variance discussion touched on most of the site specifics. The public hearing was opened at 7:52 p.m. No one appeared at the public hearing regarding this issue. Ms. Halverson moved and Mr. Hatlestad seconded a motion to close the public hearing. . The public hearing was closed at 7:53 p.m. Ms. Halverson moved and Mr. Hatlestad seconded a motion to adopt Resolution RZ03-19, recommending approval of a conditional use permit to construct a gas station with a 15- foot rear yard setback. The motion was approved on a 5-1 vote, Mr. Thompson voting nay. ADJOURN Mr. Sholtz moved and Mr. Paul seconded a motion to adjourn the meeting. The motion was approved unanimously.
