07-29-2003 ZONING AND PLANNING COMMISSION MINUTES � July 29, 2003 A regular meeting of the Hopkins Zoning and Planning Commission was held on Tuesday, July 29, 2003, at 7:30 p.m. in the Council Chambers of Hopkins City Hall. Present were Commission members Mary Hatcher, Jay Thompson, Jannina Aristy, Robert Hatlestad, Jeffrey Paul, Peter Sholtz, and Kristi Halverson. Also present were City Planner Nancy Anderson and City Attorney Jerre Miller. CALL TO ORDER Mr. Thompson called the meeting to order at 7:30 p.m. APPROVAL OF MINUTES Ms. Halverson moved and Ms. Hatcher seconded the motion to approve the minutes of the June 24, 2003, regular meeting. The motion was approved unanimously. ITEM: EAST END STUDY Ms. Anderson gave a brief overview of the history of the study. Mark Koegler reviewed the �-- study area and the reasons for the study. Since the Commission last reviewed the study, an implementation plan has been added. Mr. Thompson thanked Mr. Koegler for all the work put into the study. Ms. Hatcher moved and Mr. Sholtz seconded a motion to recommend to the City Council to adopt the East Hopkins Land Use and Market Study. The motion carried unanimously. CASE NO: CUP03-4 CONDITIONAL USE PERMIT—POLICE REMODEL Ms. Anderson reviewed the proposed additions to City Hall with the Commission. The public hearing was opened at 7:50 p.m. No one appeared at the public hearing for this item. Ms. Halverson moved and Ms. Hatcher seconded a motion to close the public hearing. The public hearing was closed at 7:51 p.m. Ms. Hatcher moved and Mr. Hatlestad seconded a motion to adopt Resolution RZ03-13, recommending approval of a conditional use permit to construct additions to City Hall for the police department expansion. The motion was approved unanimously. CASE NO: VN03-3 PARKING VARIANCE WENDY'S � Ms. Anderson reviewed the results of the parking study with the Commission. Mr. Janssen stated that the Wendy's on Blake Road was the first Wendy's in Minnesota and was constructed 30 years ago. Wendy's does not own the existing site, and the site to the south offers the opportunity for Wendy's to own the property. Frank Murray, the abutting property owner to the south, appeared before the Commission. Mr. Murray was concerned with the property line and where the fence would be located. Ms. Moss stated that the fence would be located in the middle of the buffer area between the two lots. Wendy's has done a survey. Mr. Murray stated that they would also be doing a survey to confirm the location of the south property line. Ms. Hatcher moved and Mr. Hatlestad seconded a motion to adopt Resolution RZ03-14, recommending approval of a parking variance to construct a Wendy's restaurant at 502 Blake Road. The motion was approved unanimously. CASE NO: CUP03-5 CONDITIONAL USE PERMIT—WENDY'S Ms. Anderson reviewed the site plan with the Commission. Christine Moss, representing Wendy's, appeared before the Commission. Ms. Moss reviewed the site plan with the Commission. Ms. Moss stated that they had received approval from the Watershed District to drain into the creek. The public hearing was opened at 8:15 p.m. Frank Murray, the property owner to the south ,appeared before the Commission. Mr. Murray was concerned with the following: � • Smells from the food • Lighting • Loud speaker for drive-through Mr. Janssen addressed these issues with the Commission. The Commission asked how long construction would take. Mr. Janssen stated it would take approximately 90 days. Ms. Halverson moved and Ms. Hatcher seconded a motion to close the public hearing. The public hearing was closed at 8:20 p.m. Ms. Hatcher moved and Ms. Halverson seconded a motion to adopt Resolution RZ03-15 ,recommending approval of a conditional use permit to construct a Wendy's restaurant at 502 Blake Road. The motion was approved unanimously. CASE NO: VN03-4 DRIVEWAY WIDTH— 141 16TH AVENUE NORTH Ms. Anderson reviewed the reasons for the variance. The applicant, Peggy Ross-Dahmen, and a friend, Gary Devon, appeared before the Commission. Ms. Ross-Dahmen stated she would like ` to replace the existing driveway; the existing driveway abuts the property line. MINUTES OF THE ZONING AND PLANNING MEETING Page 3 Robert Olson, the abutting neighbor to the south, appeared before the Commission. Mr. Olson �- asked for a compromise of one foot. The Commission discussed the option of using the alley for access. Ms. Ross-Dahmen stated that this would not be possible because of the elevation difference. The Commission also discussed that the existing driveway was at the property line and if the driveway were two feet from the property line, the two feet would still be used for a drive, over whatever the surface. Ms. Halverson moved and Mr. Paul seconded a motion to adopt Resolution RZ03-16, recommending approval of a driveway variance at 141 16`h Avenue North. The motion was approved unanimously. CASE NO. ZN03-5 ZONING AMENDMENT-ACCESSORY APPURTENANCES Ms. Anderson reviewed the reasons for the zoning amendment. Since last month the square footage allowed for accessory appurtenances has been reduced. The public hearing was opened at 8:56 p.m. No one appeared at the public hearing for this item. Mr. Hatlestad moved and Ms. Hatcher seconded a motion to close the public hearing. The public hearing was closed at 8:57 p.m. Ms. Halverson moved and Mr. Paul seconded a motion to adopt Resolution RZ03-12, recommending approval of ordinance 03-907. The motion was approved unanimously. `� ADJOURN Mr. Sholtz moved and Ms. Aristy seconded a motion to adjourn the meeting. The motion was approved unanimously.
