ZONING AND PLANNING COMMISSION MINUTES February 29, 2000 A regular meeting of the Zoning and Planning Commission was held on Tuesday, February 29, 2000, at 6:30 p.m. in the Council Chambers of Hopkins City Hall. Present were Commission Members Dorothy Boen, Randy Engel, Roger Gross, Eric Rudolph, John Szuba, and Ross Bartz. Also present were City Planner Nancy Anderson and City Attorney Jerre Miller. CALL TO ORDER Ms. Boen called the meeting to order at 6:30 p.m. APPROVAL OF MINUTES Mr. Engel moved and Mr. Rudolph seconded the motion to approve the minutes of the January 25, 2000, regular meeting. The motion carried unanimously. CASE NO: CUP00-1 CONDITIONAL USE PERMIT—ZION LUTHERAN CHURCH .-. Ms. Anderson reviewed the proposed additions to Zion Lutheran Church with the Commission. Ms. Anderson noted that the moratorium does not affect the proposed additions. Loren Hoseck representing Zion Lutheran Church, appeared before the Commission. Mr. Bartz asked about the stucco options for the exterior. Mr. Hoseck stated that they would like to do stone, but if the budget does not a11ow, they will use stucco. No one in the audience spoke regarding this item. Mr. Engel and Mr. Bartz seconded the motion to approve Resolution RZ00-3. The motion was approved unanimously. Ms. Swanson arrived at this time. CASE NO: VN00-1 SIGN VARIANCE- CITIZENS INDEPENDENT BANK Ms. Anderson reviewed the proposed sign with the Commission. Staff is recommending denial of the variance for lack of hardship. Mike Johnson of Graphic House appeared before the Commission. Mr. Johnson stated that it .� does not seem to make sense to have to put a time and temperature sign on the building. Mr. Johnson also reviewed the sign with the Commission. MINUTES OF THE ZONING AND PLANNING MEETING /'' Page 2 The Commission discussed hardship for the sign and amending the ordinance to allow time/temperature signs as pylon signs. No one in the audience spoke regarding this issue. Mr. Bartz and Ms. Swanson seconded the motion to approve Resolution RZ00-2, recommending granting the variance. The motion was approved on a 6-0 vote. Mr. Engel abstained. The Commission also directed staff to review the ordinance regarding changeable signs for possible amendments. CASE NO: ZN00-1 REZONING-INSTITUTIONAL Ms. Anderson reviewed the options for the Commission. The Commission discussed the pros and cons of just the CUP process vs. the rezoning and the CUP process. Mr. Gross is in favor of both the rezoning and CUP process. Mr. Gross stated that with the rezoning and CUP, the neighborhood keeps control over the residential zoning. When a rezoning comes before the City Council, the neighborhood states their opinion and the City Council votes, usually with the community. With this option the neighborhood can control what happens in the neighborhood. With a CUP the institution has to meet the CUP criteria, and the neighborhood -"� has no control. Mr. Rudolph made the point that it seems the Commission is not confident enough in the CUP language. Can the CUP ordinance be tightened to make it more acceptable? Ms. Swanson moved and Mr. Engel seconded a motion to affrm the conditional use permit ordinance to regulate the removal of single family homes. The motion failed on a 3-4 vote. Mr. Rudolph, Mr. Engel and Ms. Swanson voting aye. Mr. Gross moved and Mr. Szuba seconded a motion to set a public hearing for the March 28 meeting, for consideration of an ordinance that would rezone the institutional uses in the R-1 districts and require a conditional use permit for the removal of single family homes. The motion was approved on a 5-1 vote. Mr. Rudolph voting nay. Mr. Engel abstained from voting. ADJOURN Ms. Swanson moved and Mr. Gross seconded the motion to adjourn at 7:45 p.m. The motion was approved unanimously. ---.
