RZ06-05 CITY OF HOPKINS Hennepin County, Minnesota � RESOLUTION NO: RZ06-5 RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING FOR APPROVAL THE VACATION OF AN ALLEY WHEREAS, an application for Vacation VAC06-1 has been made by The Cornerstone Group; WHEREAS, the procedural history of the application is as follows: 1. That an application for a vacation of the alley was made by The Cornerstone Group on January 27, 2006; 2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on February 28, 2006: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of City staff were considered; and 4. A lega] description of the alley to be vacated is as follows: That part of the alley dedicated in Block 66, Minneapolis Second Division, Hennepin County, Minnesota, accruing to Lots 6 through 9 inclusive, Block � 66; except that portion of said alley vacated per pocument No. 6818606, Hennepin County Records. NOW, THEREFORE, BE IT RESOLVED that the application for vacation VAC06-1 is hereby recommended for approval based on the following Findings of Fact: 1. That the above-described alley is not needed for a public purpose. BE IT FURTHER RESOLVED that application for vacation VAC06-1 is hereby recommended for approval based on the following conditions: 1. That the site plan is approved. 2. That the preliminary/final plat is approved. 3. That Qwest have an easement for the existing conduit system. 4. That a utility easement is granted to Excel Energy.
