RZ02-13 CITY OF HOPKINS Hennepin County, Minnesota � RESOLUTION NO: RZ02-13 RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF AN ORDINANCE REZONING THE REGENCY DEVELOPMENT TO PUD WHEREAS, an application for Zoning Amendment ZN02-6 has been made by The Beard Group; WHEREAS, the procedural history of the application is as follows: 1. That an application for zoning amendment was made by The Beard Group; 2. That the Hopkins Zoning and Planning Commission published notice, held a public hearing on the application and reviewed such application on May 28, 2002: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of City staff were considered. NOW, THEREFORE, BE IT RESOLVED that the application for Zoning Amendment ZN02-6 �'" is hereby recommended for approval based on the following Findings of Fact: 1. That the overlay district is consistent with the Comprehensive Plan. 2. That the underlying zoning of R-1-A and R-1-C remain. BE IT FURTHER RESOLVED that application for Zoning Amendment ZN02-6 is hereby recommended for approval subject to the following conditions: 1. That the Applicant satisfies all conditions and requirements for and obtains final approval of the plat of the subject property. 2. That the Applicant satisfies all conditions and requirements for and obtains final approval of the conditional use permit for the proposed development. 3. That the City and the Applicant enter into an agreement that satisfies all the conditions and requirements for this PUD development. Adopted this 28th day of May 2002. � Sz a, Chair
