RZ02-10 CITY OF HOPKINS Hennepin County, Minnesota �-- RESOLUTION NO: RZ02-10 RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF A CONDITIONAL USE PERMIT TO CONSTRUCT A RETAIL AND RESIDENTIAL DEVELOPMENT WHEREAS, an application for Conditional Use Permit CUP02-3 has been made by The Cornerstone Group; WHEREAS, the procedural history of the application is as follows: 1. That an application for a conditional use permit was made by The Cornerstone Group on May 8, 2002; 2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published notice, held a public hearing on the application aud revie«-ed such application on May 28, 2002: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of City staff were considered; and � 4. A legal description of the subj ect property is as follows: Lots 1-6, Lot 46 and Lot 7, except the southerly 2 feet of said Lot 7, Slock 3, West l��inneapolis, according to the recorded�lat thereof, Hennepin County, Minnesota. NOW, THEREFORE, BE IT RESOLVED that the application for Conditional Use Pernzit CUP02-3 is hereby recoinmended for approval based on the follov��ing Findings of Fact: 1. That the proposed use meets the requirements for a conditional use pennit. BE IT FURTHER RESOLVED that application for Conditional Use Permit CUP02-3 is hereby recommended for appro��al subject to the following conditions: 1. That the watershed district approves the proposed development. 2. A details sheet must be submitted and approved along with this plan set. The City of Hopkins Engineering Guidelines should be used in developing the details sheet and the guidelines need to be specified and followed on this project. 3, A contractor's guarantee is required on this project and should be specified in accordance with the Hopkins Engineering Guidelines. � 4. A Registered Ci�-i1 Engineer must sign the Ci��il Drawings before the City can grant approvaL 5. A park dedication fee is required for each unit. 6. The Public Works Department reserves the right to continue reviewing any plans submitted for approval and to place new or revised conditions on construction as may be required. All future plan sets must be signed and submitted with revision dates. �" 7. That the applicant satisfies all conditions and requirements for and obtains final approval of the plat of the subject property. 8. That the subject property is overlaid with a PUD zoning. 9. That Cornerstone agrees to implement the parking easement letter dated May 14, 2002 to City staf£ If at a future date the easements are not implemented or are terniinated, Cornerstone agrees to undertake a parking study in accordance to a scope of work acceptable to City staff that will identify how best to address any parking deficiency if any.
