RESOLUTION NO: RZ02-9
RESOLUTION MAKING FINDINGS OF FACT AND
RECOMMENDING APPROVAL OF AN ORDINANCE
REZONING THE MARKETPLACE LOFTS DEVELOPMENT TO PUD
WHEREAS, an application for Zoning Amendment ZN02-5 has been made by The Cornerstone
Group;
WHEREAS, the procedural history of the application is as follows:
1. That an application for zoning amendment ZN02-5 was made by The Comerstone
Group;
2. That the Hopkins Zoning and Planning Commission published notice, held a
public hearing on the application and reviewed such application on May 28, 2002:
all persons present were given an opportunity to be heard;
3. That the written comments and analysis of City staff were considered.

NOW, THEREFORE, BE IT RESOLVED that the application for Zoning Amendment ZN02-5
is hereby recommended for approval based on the following Findin�s of Fact:
1. That the overlay district is consistent with the Comprehensive Plan.
2. That the underlying zoning of B-3 remains.
BE IT FURTHER RESOLVED that application for Zoning Amendment ZN02-5 is hereby
recommended for approval subject to the following conditions:
l. That the Applicant satisfies all conditions and requirements for and obtains final approval
of the plat of the subject property.
2. That the Applicant satisfies all conditions and requirements for and obtains final approval
of the conditional use permit far the proposed development.
3. That the alley is vacated.
4. That the Applicant and the City enter into an agreement that satisfies all the conditions
and requirements for this PUD development.
