RZ01-18 � � " t � CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: RZOI-18 RESOLUTION MAKING FINDINGS OF FACT AND RECONIMENDING APPROVAL OF A WAIVER OF PLAT AT 318 TYLER WHEREAS, an application for Waiver of Plat WVRO1-2 has been made by Garold Healy; and WHEREAS, the procedural history of the application is as follows: 1. That an application for Waiver of Plat WVRO1-1 was made by Garold Healy, on September 20, 2001; 2. That the Hopkins Zoning and Planning Commission, pursuant to mailed notice, held a meeting on the application and reviewed such application on October 30, 2001: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of the City staff were considered; and �" 4. Legal descriptions of the parcels are as follows: Proposed Legal Description of Westerly parcel That part of Lot 9, Block l, Stevens' Oakwood Park Hennepin County, Minnesota, which lies West of the East 111.50 feet thereof. Proposed Legal Description of Easterly parcel That East 111.5 feet of Lot 9, Block 1, Stevens' Oakwood Park, Hennepin County, Minnesota. NOW, THEREFORE, BE IT RESOLVED that application for Waiver of Plat WVRO1-2 is hereby recommended for approval, based on the following Findings of Fact: 1. That the lots meet the requirements for a waiver of plat. BE IT FURTHER RESOLVED that application for Waiver of Plat WVRO1-2 is hereby recommended for approval based on the following conditions: � RE�OLUTION NO: RZO1-18 Page 2 � 1. That Hennepin County accepts the waiver of plat. 2. That the utility and driveway easements are recorded. 3. That if the existing driveway access is not used on the easterly parcel, the access will be replaced with curb and gutter. 4. All existing utilities to the rear lot must be located or relocated within the proposed utility easement. 5.
