A RESOLUTION RECOMMENDING THE CITY COUNCIL APPROVE AN
ORDINANCE OPTING OUT OF THE REQUIREMENTS OF MINNESOTA
STATUTE, SECTION 462.3593, RELATED TO
TEMPORARY FAMILY HEALTH CARE DWELLINGS
WHEREAS, the City of Hopkins initiated an applicarion to consider an ordinance opting- out of
the Yequirements of Minnesota Statute, Section 462.3593, related to temporary family health care
dwellings; and
WHEREAS, the procedural history of the application is as follows:
1. That an application to consider an ordinance opting out of the requirements of Minnesota
Statute, Section 462.3593,related to temporary family health care dwellings;
2. That the Hopkins Planning& Zoning Coinmission, pursuant to published notice, held a
public hearing on the application and reviewed such application on July 26, 2016, and all
^ persons present wexe given an opportunity to be heard; and,
3. That the written comments and analysis of City staff were considered.
NOW,THEREFORE, BE IT RESOLVED that the Planning& Zoning Coininission of the City
of Hopkins hereby recommends that the City Council approve an ordinance opting- out of the
requi�ements of Minnesota Statute, Secrion 462.3593, related to temporary family health care
dwellings based on the following findings of fact:
1. Minnesota Statute, Section 462.3593,would pxeempt local zoning control over temporary
family health care dwellings and allow for local governments to opt out of this law.
