March 29, 2016
A regular meeting of the Hopkins Planning&Zoning Commission was held on Tuesday, March
29, 2016, at 6:30 p.m. in the Council Chambers of Hopkins City Hall.
Present were Commission Members Scott Kerssen, Brian Hunke, Matt McNeil, Gary Newhouse,
Mike Tait, Emily Wallace-Jackson and James Warden. Also present was City Planner Jason
Lindahl. •
CALL TO ORDER
Chair Kerssen called the meeting to order at 6:30 p.m.
ADOPT AGENDA
Commissioner McNeil moved, Commissioner Tait seconded, to adopt the agenda. The motion
was approved unanimously.
CONSENT AGENDA
--� Commissioner Tait moved, Commissioner Hunke seconded, to approve the minutes of the
February 23, 2016, regular meeting. The motion was approved unanimously.
PUBLIC HEARING
ITEM: Request by the City of Hopkins for a Text Amendment Related to Subdivision
Regulations (2016-09-TA)
Mr. Lindahl reviewed the application to amend Section 500 of the City Code related to waiver of
plat standards. He explained that the amendment, which was initiated by staff, allows the
platting process to be done administratively and waives the public hearing step. Mr. Lindahl
stated that a prior change in 2014 allowed consolidation of plats to be handled administratively.
The Commission raised questions about the elimination of the public hearing requirement for
administrative subdivisions and the waiver of plat processes and discussed other ways to notify
the public and let their concerns be voiced. Mr. Lindahl stated that the recommendation to
eliminate the requirement for a public hearing would apply only to a limited number of
applications that conformed to all the zoning requirements and would modernize and streamline
the process for residents and property owners. Commissioner Tait discussed the potential loss of
an easement between buildings. In response to a question from the Commission, Mr. Lindahl
stated that the difference between the current and proposed processes to be completed is 60 days
currently vs. 25-30 days at most with the proposed, streamlined process.

Public Hearing: Chair Kerssen opened the public hearing at 7:13 p.m. No one came forward to
speak. Commissioner Tait moved, Commissioner Newhouse seconded, to close the public
hearing. The motion was approved unanimously. The public hearing closed at 7:14 p.m.

Commissioner Newhouse moved, Commissioner Tait seconded, to adopt Planning Commission '��
Resolution 2016-09, recommending the City Council approve an ordinance amending Section
500 of the City Code related to waiving of plat standards. The motion was approved 6-1, with
Commissioner McNeil voting nay.
NEW BUSINESS
ITEM: 2040 Comprehensive Plan Update Process
Mr. Lindahl gave the Commission an overview of the process for updating the Comprehensive
Plan. He stated that the significant changes in this plan will be the creation of goals that are
more measurable and the increased connectivity of all components. The Planning Commission
will ultimately hold a public hearing and make a recommendation on the Plan. Mr. Lindahl's
presentation included the following ideas:
• Creation of a task force including diverse groups (ambassadors) already in existence and
the Commission's role relative to it
• Economic development plan for downtown
• Public engagement, i.e., Pecha Kucha event; existing events; through technology and
social media
Mr. Lindahl presented the following timeline:
2016: Consult with City Council and advisory boards; form internal team led by Planning
department; hire consultant for technological parts of plan; soft launch of public —
engagement process in summer.
2017: Task force will create timeline for 2017 work and complete first draft.
2018: Finish final draft and submit to surrounding cities and communities for comments for
period of six months.
2018: Planning & Zoning public hearing and recommendation followed by City Council
approval.
The Commission had the following comments:
• The plan should have geographic balances; and every neighborhood should be included
• Best way to get representation is go to where people live, schools, make people
comfortable, be informal, social media
• Consider financial impacts of different land uses
• Ask what is unique about Hopkins in addition to "What do you like?"
• Make plan vital
• Understand we don't know the future�lon't box in, make it malleable
• Plan should be broad; have everyone's perspective
• Should expansion of downtown be discussed?
The Comp Plan will cover many different topics, so the task force should be diverse and more
than just the Planning&Zoning Commission. Several Commissioners stated they would like the
Commission to be very engaged. Mr. Lindahl stated that he anticipates giving monthly updates
on the Plan to the Commission. �"

ANNOUNCEMENTS
Staff inet with Minnetonka staff to develop Shady Oak zoning standards. The goal is to review
and develop with the Commission by the end of the year.

Commissioner McNeil moved, Commissioner Newhouse seconded, to adjourn the meeting. The
motion was approved unanimously. The meeting adjourned at 8:05 p.m.

Overview
The Japs Olson Company, located at 7630 Excelsior Boulevard,requests subdivision approval to
combine and plat their existing properries into one parceL Wlvle the subject property is located
in St. Louis Park, part of this process will dedicate a porrion of the abutting Powell Road to the
Ciry of Hopkins. As a result, the City of Hopkins must approve the plats. Should the City of
Hopkins approve the subdivision request, the abutting porrion of Powell Road will be dedicated
to Hopkins. Staff finds the proposed preliininary and final plats in conformance with the City's
subdivision standards and recomtnends the City approve this request.

� Background
The Japs Olson properry at 7630 Excelsior Boulevard had the Hopkins/St. Louis Park city
boundary running through the lot and building (see attached maps). Japs Olson wanted to
expand their e�sting building in St Louis Park and acquired the property abutting 7630
Excelsior Boulevard in Hopkins. To facilitate this expansion, Hopkins swapped its portion of
7630 Excelsior Boulevard for the properties at 8000 and 8050 Powell Road and 4103 and 4101
Texas Avenue South. This transacrion was processed through an annexarion that was approved
by Hopkins, St. Louis Park and the State of Minnesota Office of Adiniiustrarive Hearings at the
end of 2015.
During the subdivision and building expansion review process with St Louis Park,it was
discovered that the abutting porrion of Powell Road is located within the City of Hopkins and
must be dedicated to Hopkins when the plat is recorded with Hennepin County. As a result, the
City of Hopkins must also review, approve and sign the Japs Olson plat.
Legal Authority. Subdivision approvals are considered quasi-judicial actions. As such cases,
the City is acting as a judge to deteriiune if the regularions within the Comprehensive Plan,
Zoning Ordinance and Subdivision Ordinance are being followed. Generally,if the applicarion
meets these requirements, it must be approved.
Primary Issues to Consider
Preliminary and Final Plat Design. Standards for reviewing subdivision requests are outlined
'"� in Secrion 500 of the City Code. This secrion of the Code details a two-step preliminary and
final plats process for land subdivision. In this case the applicant Yequests the City review
prelinvnary and final plats concurrently.
In this case, the details of the plat were reviewed and approved by St. Louis Park on February 1,
2016 (see attached resolurion). The plats indicate the applicant owns two parcels that they wish
to combine into one property. The larger parcel is approximately 383,447 square feet and
contains the e�sting Japs Olson producrion facilit��. The other parcel is approxixnately 84,310
square feet and includes the easement portion of Powell Road that must be dedicated to the City
of Hopkins.
Streets and Access Standards. The final plat includes the portion of Powell Road within the
City of Hopkins. Specifically, they show a 34' wide street and utility easement per document
number 2902358. The City Engineer has reviewed the plat and recommends accepting
dedication of this porrion of Powell Road to Hopkins (see attached memo).
Park and Open Space Standards. Given the subject property is located in the City of St.
Louis Park, Hopkins may not collect park dedication fees on this plat.
Alternatives
1. Recommend approval of the preliininary/final plats. By recommending approval of the

preliininary/final plats, the City Council will consider a recommendarion of approval.
2. Recommend denial of the prelunuiary/final plats. By recommending denial of the

As a part of the land swap between Hopkins and St. Louis Park to allow for the Japs-
Olson site improvements, a portion of Powell Road along the site was transferred to

RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING
APPROVAL OF A PRELIMINARY AND FINAL PLAT FOR JAPS OLSON ADDITION
WHEREAS, an application for both preliminary and final plats were submitted by the Japs
Olson Company; and
WHEREAS, the procedural history of the application is as follows:
1. That applications for both preliminary and final plats were submitted by the Japs Olson
Company on March 25, 2016;
2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published
notice, held a public hearing on the applications and reviewed such applications on April
29, 2016: all persons present were given an opportunity to be heard;
3. That the written comments and analysis of City staff were considered; and,
4. The legal descriptions of the parcels are as follows:

117, Range 21, described as follows:
Commence at the Northeast corner of the Quarter-Quarter; thence Westerly along the
North line thereof 700 feet; thence Southerly along a line parallel with the West line of
said Quarter-Quarter 642.5 feet to the center line of Excelsior Avenue; thence Easterly
along the center line of Excelsior Avenue to the East line of said Quarter-Quarter; thence
Northerly along said East line to point of beginning, except the West 49 feet of the

for Japs Olson Addition are hereby recommended for approval and the City of Hopkins shall accept
dedication of the abutting portion of Powell Road based on the following Findings of Fact:
l. That the preliminary and final plats conform to the requirements of the City's
Comprehensive Plan, zoning regulations and subdivision standards.
BE IT FURTHER RESOLVED that application for preliminary and final plats for Japs Olson
is hereby recommended for approval based on the following conditions:
1. Conformance with all requirements of the City's Comprehensive Plan, zoning regulations,
and subdivision standards.
2. Conformance with all requirements of the City Engineer.
