Present were Commission Members Brian Hunke, Matt McNeil, Charles Firth, Andrew Fisher, Scott Kerssen and Emily Wallace-Jackson. Mike Tait was absent. Also present was staff inember Nancy Anderson. CALL TO ORDER Mr. Kerssen called the meeting to order at 6:30 p.m. in the Council Chambers. APPROVAL OF MINUTES Mr. Firth moved and Ms. Wallace-Jackson seconded the motion to approve the minutes of the March 31, 2015, regular meeting. The motion was approved unanimously. � ITEM: ZONING AMENDMENT—INDUSTRIAL DISTRICT - RETAIL Ms. Anderson reviewed the reasons for the amendment to the Industrial district. The public hearing was opened at 6:40 p.m. No one appeared at the public hearing. Mr. Fisher moved and Mr. Hunke seconded a motion to close the public hearing. The motion was approved unanimously. The public hearing was closed at 6:41 p.m. Mr. McNeil moved and Ms. Wallace-Jackson seconded a motion to adopt Resolution RZ15-9, recommending approval of zoning amendments in the Industrial zoning district. The motion was approved unanimously. ITEM: ZONING AMENDMENTS—PERFORMANCE STANDARDS/SITE PLAN Ms. Anderson reviewed the reasons for the amendments to the performance standards and site plan approval. The public hearing was opened at 6:45 p.m. No one appeared at the public hearing. Mr. McNeil moved and Mr. Firth seconded a motion to close the public hearing. The motion was approved unanimously. The public hearing was closed at 6:46 p.m. Mr. Firth moved and Mr. Hunke seconded a motion to adopt Resolution RZ15-8, recommending approval of zoning amendments to the performance standards. Overview The building at 1011 First Street is now a site for Hennepin County Services. At one time Wells Fargo Bank occupied more of the building than it currently does. The only signage on the building now is advertising for Wells Fargo. Hennepin County Services moved in last year and has no signage on the building. The proposed Hennepin County sign is 5' x 5', which is 25 square feet. The sign is proposed to be located on the southwest corner of the site. The building is zoned B-2, Central Business. This zoning district allows two square feet per front foot of building. The building's front yard is 11'�' Avenue. The building is 145 feet along 11`h Avenue. The site is allowed 290 square feet. The building currently has 462 � square feet of signage. The proposed sign would be on a 5' x 2.25' pedestal, for a total height of approximately seven feet. Primarv Issues to Consider • What is the zoning of the property, and how has the Comprehensive Plan designated the subject site? The subject property is zoned B-2, Central Business. The Comprehensive Plan has designated the site as Commercial. • What does the ordinance require? The ordinance allows two square feet of signage per front foot of building. The site is currently over on signage by 172 square feet. • What are the specifics of the applicant's request? The applicant is requesting a 5' x 5' sign located on the southwest corner of the site. The proposed sign will be non-illuminated. • What practical difficulties does the property have? ^ The new state statute requires three standards for the granting of a variance. The three requirements are: 1. Practical difficulties cited in connection with the granting of a variance, i.e. property owner proposes to use the property in a reasonable manner not permitted by an official control; 2. The plight of the landowner is due to circumstances unique to the property, not created by the landowner; and 3. The variance, if granted, will not alter the essential character of the locality. The applicant does not meet the three requirements to grant a variance. The building is over the allowed square footage for signage, but the landowner will not remove signage to accommodate the new occupant in the building. The location of the sign is also not ideal. Cars going north on l lth Avenue will see the sign, but coming from other sides the sign will not be visible. • Are there options for Hennepin County without a variance? Signs under six square feet do not require a permit. Signs fewer than six square feet could be erected over both the north and south doors to provide signage for Hennepin County. Alternatives � 1. Recommend approval of the sign variance variance. By recommending approval of the VN15-1 Page 3 sign variance, the City Council will consider a recommendation of approval. If the Planning Commission considers this alternative, findings will have to be identified that support this alternative. � 2. Recommend denial of the sign variance. By recommending denial of the sign variance, the City Council will consider a recommendation of denial. 3. Continue for further information. If the Planning Commission indicates that further information is needed, the item should be continued. � �� CITY OF HOPKINS ,-. HENNEPIN COUNTY, MINNESOTA RESOLUTION NO: RZ15-10 RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING DENIAL OF A SIGN VARIANCE WHEREAS, an application for Variance VN15-1 has been made by Mike Vaske on behalf of Hennepin County, and WHEREAS, the procedural history of the application is as follows: 1. That an application for Variance VN15-1 was made by Mike Vaske on behalf of Hennepin County on Apri123,2015; 2. That the Hopkins Zoning and Planning Commission, pursuant to mailed notice, held a meeting on the application and reviewed such application on May 26, 2015: all persons present were given an opportunity to be heard; and, 3. That the written comments and analysis of the City staff were considered. NOW, THEREFORE, BE IT RESOLVED BY THE ZONING AND PLANNING COMMISSION OF THE CITY OF HOPKINS, MINNESOTA, that application for Variance �,,,� VN15-1 to allow more signage than allowed at 1011 First Street South is hereby recommended for denial based on the following Findings of Fact: 1. That the applicant does not have a circumstance peculiar and unique to the parcel and that the property owner has reasonable use of the property. 2. That the excess amount of signage on the site was created by the landowner. BASED ON THE FOREGOING FINDINGS OF FACT, the Zoning and Planning Commission of the City of Hopkins, Minnesota, hereby determines that the literal enforcement of the amount of signage would not cause practical difficulties because of circumstances unique to the subject property, that granting of the requested variance to the extent necessary to compensate for such practical difficulties is not keeping with the intent of the Hopkins City Code, and that the variance of an additiona125 square feet of signage is not reasonable.
