PLANNING COMMISSION
REPORT N0 : i��C86-7 November 14 , 1986
PURPOSE: To review and recommend action on a rezoning
at County road 3 and 11th Avenue South .
BACKGROUND•
Name of Applicant : Midwest Auto Malls
Address of Property: Northeast corner of
11th Avenue South and County Road 3 .
Present Zoning: B-2
Proposed Zoning: B-3
Nature of Request : Rezoning to allow auto
repair
Reason for Request : B-2 district does not
— allow auto repair .
This rezoning is in conjunetion with the Conditional.
Use Permit and street vacation request to construct an
Auto Mall .
The applicant is proposing to construct an Auto Mall at
the former site of White Motor office and CPT . The
present zoning is B-2 , however this zoning does not
allow auto repair .
427 • 35 requires a minimum lot size of 3000 sq . ft . and
a lot width of 25 feet . The subject site meets the
minimum lot requirements for a B-3 district lot . The
site is surrounded by a B-2 district to the north , an
R-5 district to the west , a B-3 district to the south
and an I-1 district to the east . The Comprehensive
Plan designates this area as Central Business District .
ANALYSIS : This site is an exeellent site for commercial
business because of the amount of traffic on County
Road 3 and 11th Avenue South .

The subjeet parcel is currently zoned B-2 , however ,
auto repair is not permitted . The type of auto repair
that is proposed is minor repair and will not consist
of �unk cars and parts throughout the parking area .
The proposed businesses conduct minor repairs . In many
cases the customers will wait for their cars to be
finished . The proposed development is consistent with
the Comprehensive Plan .
ALTERNATIVES:
1 . Approve the rezoning contingent upon the
applicant securing use of Second Street
South .
2. Disapprove the rezoning . If the
Commission takes this course of action , the
applicant will not be able to construct the
Auto Mall .
RECOMMENDATION : I recommend approval of the rezoning .
The following are suggested Findings of Fact and
Conditions should the Commission recommend approval :
1 . The proposed use is consistent with the
surrounding uses .
^ 2 . That the subject lot meets the minimum
requirements for a B-3 District .
3 . That the proposed zoning is consistent
with the Comprehensive Plan .
Conditions:
1 . The applicant secures use or ownership of
Second Street South.

AN ORDINANCE AMENDING HOPKINS
CITY CODE SECTION 545 . 15 BY REZONING
PARCELS IN WEST MINNEAPOLIS FROM B-2 TO B-3
BE IT ORDAINED by the City Council of the City of
Hopkins as folloWs :
SECTION 1 . That the present zoning elassification
of B-2 upon the following described premises is hereby
repealed and in lieu thereof the said premises are hereby
zoned B-3 :
North 20 feet of Lot 7 and 12 , including adjacent
alley vacated , Block 11 , West Minneapolis .
That part of Lot 1 lying easterly of the folloWing
described line : Commence at a point in southerly

line of said Lot 1 distance 280 feet easterly from
southwest corner thereof , thence northerly at
right angles 88 6/10 feet , thence deflect to the
left 41 degrees to north line of said lot and
there terminating ; also that part of Lot 1 , Dows
Homestead West Minneapolis beginning on east line
thereof at a point distance 299 8/ 10 feet south
from south line of First Street South , thence
south 20 feet , thence West parallel with south
line of First Street to west line of Lot 1 , thence
easterly to beginning , Auditor ' s Subdivision No .

described line : Commence at a point in southerly
line of said Lot 1 distant 280 feet easterly from

SECTION 2 : That the presently existing Hopkins

545 . 15 is hereby amended and changed in aceordance with the
above provisions .

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR REZONING ZN86-7
WHEREAS , an application for Rezoning entitled
ZN86-7 has been made by MidWest Auto Malls for rezoning of
property at County Road 3 and 11th Avenue South to allow
auto repair .
WHEREAS , the procedural history of the application
is as follows :
1 . That an application for Rezoning ZN86-7
was filed with the City of Hopkins on
October 30 , 1986 .
2 . That the Hopkins Planning Commission
reviewed such application on November
25 , 1986 .
3 . That the Hopkins Planning Commission ,
� pursuant to published and mailed
notices , held a public hearing on
November 25 , 1986 ; all persons present
at the hearing Were given an opportunity
to be heard .
4 . That the written comments and analysis
of the City Staff and the Planning
Commission xere considered .
NOW THEREFORE , BE IT RESOLVED , that the Hopkins
City Council makes the folloWing Findings of Fact in respect
to ZN: 86-7 :
1 . The proposed use is consistent with the
surrounding uses .
2 . That the subjeet lot meets the minimum
requirements for a B-3 District .
3 . That the proposed zoning is consistent
with the Comprehensive Plan .
BE IT FURTHER RESOLVED , that application for
