REZONE LOTS ON HARRISON SOUTH
PLANNING COMMISSION
REPORT N0. ZN86-2
PURPOSE: To review and recommend action on a rezoning application to rezone
from R-1-A to B-3.
BACKGROUND:
Name of Applicant: Gary L. Capone
Address of Property: Two lots immediately south of 702 East Excelsior Ave.
Present Zoning: R-1-A
Nature of Request: To rezone from R-1-A to B-3

Reason for Request: To construct a storage building.
The applicant is proposing to build a 50'x50' storage building on the two
lots adjacent to his business at 702 East Excelsior Avenue. The subject
property is zoned R-1-A. In order .to construct a storage building the
zoning would have to be changed. A warehouse is a permitted use in a B-3
district.
The subject lots are approximately 6096 and 5956 square feet. The lots
meet the minimum requirements of the B-3 district.
Currently the site is an empty lot used for parking and storage by the
applicants business. Blake School is to the east, homes to the south
and west, and Surge Water to the north.
The applicant has contacted the surrounding neighbors, it appears none have
objected , however, I am unable to determine if the neighbors realize that
the zoning will have to be changed in order to construct the proposed build-
ing.
ANALYSIS:
Anything done to this site would be an improvement, however, to rezone
would intrude into a residential area. If this rezoning would be allowed
a precedent would be set for other businesses along Excelsior Avenue to
do the same.
� RECOMMENDATION:
I recommend denial of the rezoning.

RESOLUTION N0. 86-35
RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION ZN86-2 FOR REZONING
WHEREAS, an application for rezoning entitled ZN86-2 has been made by
Gary L. Capone of 702 East Excelsior Avenue, for rezoning of Lots 31 and 32,
Block 19, West Minneapolis Center, from R-1-A to B-3, to allow construction
of a storage building.
WHEREAS, the procedural history of the application is as follows :
1. That an application for rezoning ZN86-2 was filed with the City of
Hopkins on March 28, 1986.
2. That the Hopkins Planning Commission reviewed such application on
April 29, 1986.
3. That the Hopkins Planning Commission, pursuant to mailed notices,
held a public hearing on April 29, 1986; all persons present at the
hearing were given an opportunity to be heard, and the Hopkins City
Council , pursuant to published and mailed notices, held a public
hearing on June 3, 1986; all persons present at the hearing were
given an opportunity to be heard.
-- 4. That the written comments and analysis of the City Staff and the
Planning Commission were considered.
NOW, THEREFORE BE IT RESOLVED, that the Hopkins City Council makes the
following Findings of Fact in respect to ZN86-2:
1. The lot would meet the minimum ]ot requirements for a B-3 District.
2. That no neighbors have objected to the rezoning.
3. The site would be aesthetically improved with inside storage.
4. The site would not be conducive to construction of a single family
home.
