grouad. A motion was duly made and carried to pase the neaessary resolutions to

The bond. of A. G�l. Elmquist, as Treasurer, with the �ational Suret�

that there c�as too bi� a cut to make and tne Village on1�T ���e�'one-'r�.lf of the
street and, therefore, they did not reco�end the opening and grading of Fifth
�venue at this time.
The Road Committee recoinmended the �;rading and �ravellin� of the alley
bet�een Eighth and Nineth Avenues tznd �xcelsior Ave., and �irst Street. On a
- motion duly made azd carried it �ras decided to grade and �°ravel this alley.
� The Civi� Cor�erce �ssociation requested that the �illage Counail meet
with their committee on thE llth Avenue matter. On. a motion cluly made and
carried the Villa�;e Council F��as. to meet �vith the Civil Commerce �ssociation
Committee and the �i. T. �. officials for the purpose of trying to arrive at a
settlement in regards to the llth Avenue South.

AND �,�REaS, The United States postal authorities ha,ve desi�nated
the name of the post office in said� village as Hopkine,

village as incorporated, namely the village of �aTest P�inneapolis, and the
name of the post-office as designated as Hopkiris,
AND T`1I�REAS, `rhe General Statutes" of �dinnesota for 1923, Section

CHANGE OF NAN� ,OF FI7�LAGE:-- That the name of a�i iiz-
corporated village in this state may be changed to the same name ,

declaring, duly and legally adopted by the council thereof, when-
ever the name of suCh village as incorporated is different than
the name of the post-office in such nillage, as desi�;�a.ted by the
United States postal authorities. � �
And Section 1194 of said Statutes provides as follorvs:

July 17, 1928, at whiah time same will be opened for oonsideration. �

and 1360 feet, more or less, in length, and shall include all necessary w�res
and manholes a.nd shall be laid in acoordance with plan.s and specifiaations on
file in the office of the Recorder of said Village of S{�est fl�inneapolis, Post
Office, Hopkins, Minnesota, pursuant to Chapter 3S of Law� of lt4innesota, Por

Proposals therefor to be considered must be made on a basis of cash
payment for the said vrork, labor and material; and must be accompanied by a

o'clock P. �I. Tuesd.a,y Jul� 17, 1928, and then publicly opened and oonsidered,
for the construotion of egtension to the v��atermains in and for the said
Village, in accordance �vith the plana and speQifioations therefor now on file
in the office of the Village �iecorder.
' The work will consist of approximately 1862 lineal feet oP cast
iron pipe mains, together with Y�ydrants, valves, specials, and cox�nections to
the existing mains. .

Bids must be_ on the blank forms furnished b,y the Villagro and must
be accompanied b� a duly certified check or bidder's bond in a ativn equa.l to
not less than.l5� of the amount of the bid, payable to the order of the
Village Treasurer, to be forfeited as liquidated damages (not penalty) by
ax�p bidder who is a� rded the contract and who fails to execute the cantract
and to furnish the required bond promptly. All bids must be�made on the basis
of cash payment for the work.
Plans and speaifications may be seeri and blank proposals obtained
at the office of the Village Fiecorder.

In Re : Schiller+s application for license- ,
Curb Gasoline Pumps. , � , � �
Section 4 of the Village Ordinance relating to�the licensing
� of gasoline filling stations and curb pumps provides that " rior li'cense
shall be issued for operating any gasoline filling station on any �
sidewalk or any portion of any public street other than at the several
locations where such stations actually exist and are now operated
at the time the ordinance takes effect,�until such person shall give
a bond for �5000.00 to indemnify the Village against an� loss and
damage, etc.".
�r. Schiller informs me �that he established the curb pump
in the sidewalk abutting his property long before the ordinance took
effect and thereafter rented the property to Mc�ueen Bros. The pumps
were in operation at the time when the ordinance took effect, but
McQueeX� Bros, never took out a license and afterwards discontinued
the us e of the curb pumps . 1VIr . Schi ller was not inf ormed of the
adoption of the ordinance and did not learn thereof until after
McQueen Bros, gave up the property and turned it back to him, and
upon learning of the failure on the part of Mc�ueen Bros. to take
out a license, he then made the present application. He feels that.
he acted promptly and just as soon as he was informed of the situ-
ation. � �
One of the purposes and objects of the ordinance was to do
away with curb pumps and to preve nt the establishment of any new
ones.
In submitting this ordinance to the Council, I furnished
the Council with a memorandum opinion dated May 9th, 1927, irom ,
which I quote 'as follows :-'�I wish to c�ll particular attention to
the provision of Section 4 of the proposed ordinance, which pr.ohibits
the issuance of a license for any filling station on any sidewalk
or any portion of any public street other than at the several
locations where such stations actually exist.� I entertain very
serious doubts as to the legality of any license or permit which.
assumea to allow the private use of any portion of the public streets
or sidewalk. Ui course it is proper to license those pumps or
filling stations which now actua lly exist ori a ny sidewalk, subject
to the paramount public rights by virtue of any law, statute, or
otherwise."

��Regarding the claim of an abandonment of its franchise by
non-user, the authorities are clear that, to warrant a court
in basing a decres upon that ground, the abandonment must be a
clear, unequivocal and decisive act of the party sho�ving a
determination not to use or claim the benefit of its franchise.`�

Mr. Schiller contends that in this case there was not an
unequivocal and decisive abandonment, but that�it was merely a
discontinuance of the use of the pumps on the part of MeQueen Bros.,
who held a contract for obtaining gasoline from the 1'ure Uil Company,
avhich company discontinued its contract owing to the establishment
of one of their own stations in the Village, and for the further
reason that I�c�;ueen Bros, were, during the period of the discon-
tinuance of the use of their pumps, looking around for an opportunity
to dispose of their business, and, Mc�ueen Bros. having in mind the
sale and disposition of their business, did not seek a contract
for obtaining gasoline from any other company.

Mr. Schiller urges that his proprietary rights should not
be forfeited.
�uoting from one of our own Supreme Court decisions: -
"A municipality cannot deny an application f or a license arbitrary
or unreasonably. On the other hand the Council may in the exercise
of' its good discretion and under the provisions of the ordinance
referred to, revoke any license or permit granted, or may refuse
to grant a lic.ense if in their judgment it appears that the granting
of such license would operate,against the public health, safety or
welfare. The Council may waive a forfeiture for non-user': 44 C.J.1102.
There is no provision in the ordinance which operates to
. ext.ir,gvish rvhatever rights �xisted at the time when the ordin�nce took

consider.%this application just the same as though it were made at
the time when the ordinance took effect, disregarding the discontin-
uance of the operation of the pumps as an element operating as a
forfeiture or abandonment of previous existing rights, and treat
this application just the same as any other timely application. If
the Council considers that public polic,y will be best served by
denying the application, place your denial on that ground rather
than upon an abandonment o r for�'eiture.,of existin� ri�hts.
The Council would be quite justified in considering the
statements made in Mr. Schiller's letter accompanying his application
as justifiable circumstances, excusing failure to act more promptly
in applying for the license. A municipality has the right to waive
strict compliance where justifiable reasons exist.
I am told that immediate action should now be had on this
application for the reason that the Pure Uil Company desire to
relieve themselves from any and all further liability and respons-
ibility b,y taking up the tanks or turning the same over to Mr.
Schiller.
