Staff recommends approval of the following motion: Move to approve Resolution No: 90-115 approving Ordinance 90-687 for first reading to allow�overnmental signs to be exempt from the zoning requirements. Approval of this motion will amend the zoning ordinance to allow governmental signs to be exempt from the zoning requirements. The Zoning and Planning Commission unanimously approved Resolution No: Z90-16 recommending approval of Ordinance No: 90-687 . Overview. The total signage for a property is determined by the amount of frontage. In industrial districts a lot is allowed 4 square feet per front foot of lot and 1 square foot per foot of side yard. The property owner can divide up total signage to fit the sites needs. The Jaycees have donated money for entrance signs in the City. The first one is being constructed on the Powell Candy property. Powell Candy has enough square footage on their property to allow the � entrance sign. However, the sign is not theirs, and should not be counted against their total signage for the site. Also, this sign is one of possibly four that will be erected. In the future a site may not have the square footage to allow another sign on the site. The new ordinance would allow signs to be erected by the City without decreasing the property owners square footage for signage. The City would still have to get permission from the property owners to erect the sign. Staff reviewed the proposed ordinance change. The Commission was concerned with the type of entrance sign to be constructed and , the lease with Powell Candy Company. The new ordinance will have no impact on the new entrance sign. The only impact will be to not count the square footage of the entrance sign against Powell Candy. o What type of signs can be erected with the current ordinance? The existing ordinance allows the City to erect signs such as street signs or directional signs in the public right-of-way. These signs are exempt - from complying with the requirements in the sign section of the ordinance. The new ordinance would allow entrance signs to be exempt from the sign ordinance. The new ordinance will also allow the signs erected by the City to be on private property. � o What will the proposed ordinance allow the City to do in the future? The new ordinance will allow entrance signs to be erected by the City without complying with the sign ordinance. The sign ordinance now exempts some signs, such as display or directional in the public right-of-way. However, the new ordinance will define entrance signs and allow entrance signs to be erected by the City on private property and on the City right-of-way. Alternatives. � 1. Recommend approval of the new ordinance. By recommending approval of the ordinance, governmental signs will be exempt from the sign ordinance. 2. Deny the new ordinance. By denying the ordinance may governmental signs will be counted against the property owners total signage. 3. Continue for further information. If the Council indicates that further information is needed, the item should be continued. �. � CITY OF HOPKINS Hennepin County, Minnesota � ORDINANCE NO. 90-687 AN ORDINANCE AMENDING HOPKINS ZONING ORDINANCE NO. 515-570 PERTAINING TO SIGNS BE IT ORDAINED, by the City Council of the City of Hopkins as follows: That the Hopkins Zoning Ordinance No. 515-570 be and the same is hereby amended by adding the following provision: 570. 01 Subd. 9. Sign - aovernmental signs: permanent governmental signs for control of traffic and other regulatory/notification purposes, street signs and entrance signs. Section 570. 01 is renumbered in accordance with this ordinance. ^ That the Hopkins Zoning Ordinance Section No. 570 be and the same is hereby amended as follows: 570.23 Subdivision 1. Exceptions. Subsections 570. 01 to 570. 61 do not apply to any directional and governmental signs which are authorized by the City for erection in the public right-of-way, or on private property, or to any on-site private instructional signs which are so located and intended to aid persons who are on the private parcel of land providing that any such instructional signs do not exceed an area of four a square feet. WHEREAS, the procedural history of the amendment is as follows: 1. That the application for a Zoning Amendment was filed with the City of Hopkins on October 2, 1990. 2 . That the Hopkins Planning Commission reviewed such application on October 30, 1990. 3 . That the Hopkins Planning Commission, pursuant to published notices, held a public hearing on October 30, 1990; all persons ,....� present at the hearing were given an opportunity to be heard. 4. That the written comments and analysis of the City Staff and the Planning Commission were considered. NOW THEREFORE BE IT RESOLVED, that application for Zoning Amendment ZN:90-6 is hereby approved subject to the following Findings of Fact: 1. That various signs erected by the City do not , meet the requirements in the Zoning Ordinance. 2o That the proposed ordinance will allow various signs erected by the City to be exempt from the Zoning Ordinance.
