ZONING ORDINANCE AMENDMENT - ACCESSORY STRUCTURES
Proposed Action.
Staff recommends the following motion: Move to adopt Resolution 03-65, approving
Ordinance 03-907, allowing higher accessory structures in industrial districts for first
reading.
At the Zoning and Planning meeting, Ms. Halverson moved and Mr. Paul seconded a motion
to adopt Resolution RZ03-12, recommending approval of Ordinance 03-907, allowing higher
accessory structures in industrial districts. The motion was approved unanimously.
Overview.
The previous item for a height variance was for an accessory structure in an industrial
district. The present ordinance does allow an increase in height for various similar structures
such at water towers or church spires, but not juice towers. The staff felt that in industrial
districts there might be cases in the future where accessory-type structures might need to
exceed the minimum height. If Citrus Systems needed a water tower on the site, the
ordinance would have allowed this without a variance. The following amendment will allow
accessory structures not exceeding five percent of the lot to increase the height requirement
by 50 percent.

. What is the proposed amendment?
540.05. f) Structures for necessary mechanical appurtenances or storage,
covering not more than five percent of the lot, may increase the height bv 50 percent of the
allowed maximum height.
. What was the discussion at the Zoning and Planning meeting?
Ms. Anderson reviewed the reasons for the zoning amendment. Since last month the square
footage allowed for accessory appurtenances has been reduced. The Commission indicated
that the reduced square footage for accessory appurtenances was acceptable. No one
appeared at the public hearing.
Alternatives.
1. Approve the amendment to the zoning ordinance. By approving the amendment to the
zoning ordinance, the Zoning Ordinance will be amended.
2. Deny the amendment to the zoning ordinance. By denying the amendment to the zoning
ordinance, the Zoning Ordinance will not be amended. If the City Council considers this
alternative, findings will have to be identified that support this alternative.
3. Continue for further information. If the City Council indicates that further information is
needed, the item should be continued.

RESOLUTION NO: 03-65
RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING AN ORDINANCE AMENDMENT
WHEREAS, an application for Zoning Amendment ZN03-5 has been made by the City of
Hopkins;
WHEREAS, the procedural history of the application is as follows:
1. That an application for zoning amendment was made by the City of Hopkins;
2. That the Hopkins Zoning and Planning Commission published notice, held a
public hearing on the application and reviewed such application on June 24 and
July 29,2003: all persons present were given an opportunity to be heard;
3. That the written comments and analysis of City staff were considered.
NOW, THEREFORE, BE IT RESOLVED that the application for Zoning Amendment ZN03-5
is hereby approved based on the following Findings of Fact:
1. That the proposed amendment protects the health, safety, and welfare of the
community.

THE COUNCIL OF THE CITY OF HOPKINS DOES HEREBY ORDAIN AS
FOLLOWS:
That the Hopkins Zoning Ordinance No. 515-570 be, and the same is hereby
amended by amending and adding the following sections:
540.05. Permitted accessory uses. The following are permitted accessory uses III
Industrial districts:
f) Structures for necessary mechanical appurtenances or storage. covering not more
than .25 percent of the building footprint. may increase the height by 50 percent of the
allowed maximum height.
