CR 08-011 Amending Section 1185 MassageJanuary 23, 2008 Council Report 2008 -011 Proposed Action Staff recommends adoption of the following motion: to approve Ordinance 2008 -995 for first reading. Overview About one month ago, a massage therapist called to ask if she need a license from Hopkins if she is licensed by the Minnesota Board of Medical Practices for acupuncture. Acupuncture can be accomplished both with needles and by applying pressure, such as massage, to specific areas of the body. Both practices utilize some of the same methods. Subdivision 3 is being removed, because the fee section of the ordinance was changed by ordinance 2006 -963 to allow for prorating of fees. Primary Issues to Consider • This is basically a housekeeping item. The intent of the ordinance never was to require that a person who was already licensed by a medical board be required to obtain a Hopkins license for massage. Section 1 185 is amended as follows: 1185.05 License Required. Subdivision 1. It shall be unlawful for any person to practice as a massage therapist in the City of Hopkins without first obtaining a license to do so. Subd. 2. The license will be effective for one year and run from July 1 through June 30 of the license year. (Amended Ord. 2003 -899) Subd. 3. Exclusion. Any person who is licensed by the Minnesota Board of Medical Practices shall not be required to obtain a massage license from the City of Hopkins. Section 2. ATTEST: Subd. 3.
