Memo - Moratorium on Lots Less than 40 ft wide
Memorandum To: City Council From: Nancy Anderson Date: 12/5/2003 Re: Moratorium on the construction on lots less than 40 feet in width I. INTRODUCTION A moratorium on the construction of structures on lots less than 40 feet became effective on June 12th. This moratorium was put in place to give the City Council time to review the current ordinances. In the past year there have been several building permits to construct single- family homes on lots less than 40 feet in width. This creates a challenge for the builder because of the setbacks on a narrow lot. •Variances have been requested on the side yard setbacks. The purpose of discussion at this work session is to provide direction to staff on possible amendments to the zoning ordinance regarding smaller lots and the grandfather clause in the zoning ordinance. II. EXISTING ZONING ORDINANCE REQUIREMENTS. Currently the zoning ordinance allows a lot of record that does not meet the minimum requirements of the ordinance in that zoning district to have a single- family home constructed if the lot is 2/3 of the minimum requirements. In the R -1- A zoning district, the minimum lot width is 50 feet. This clause allows lots of 33.5 feet to have a single- family home constructed in the R -1 -A zoning district. This clause applies to all the R -1 zoning districts. For R -1 districts that have a larger minimum width, the 2/3 requirement will, of course, result in a larger lot on which to build. III. POSSIBLE STUDY ITEMS. 1. Should the ordinance continue to allow construction on lots that are less than the current requirements? • Attachment December 5, 2003 2. Should the ordinance allow a home to be removed that is currently on more than one lot to allow two homes to be constructed if the two lots do not meet the current minimum lot dimensions? 3. Should the setbacks be changed? (smaller — larger) 4. Should the 2/3 minimum requirement be changed?
