School Liaison Officer Services Agreement for District #270
Proposed Action
Staff recommends adoption of the following motion: Move to approve an a~reement
between the City of Minnetonka and the Hopkins Police Department to fund a
portion of the Community Service Officers for the Hopkins Public Schools for
2003.
Overview
.
The Minnetonka Police Department provides the services of three police officers and
_ related support services and supplies to provide the Hopkins School District with Junior
and Senior High Liaison Officers. The Minnetonka Police Department agrees to provide
supervision, training and fringe benefits to support the officers assigned to these duties.
The Hopkins School District agrees to provide office space, telephone and office
support services; the District also pays 50 percent of the total cost. Portions of the
remaining cost of services are shared by the communities within the Hopkins School
District boundaries as reflected in their portion of the student population living within
their borders. The Hopkins share of that of that cost has been 14 percent under past
agreements. Total cost for services in 2003 is $171,768. The city of Minnetonka is
requesting that the city of Hopkins share be 14 percent in the 2003 agreement. Hopkins
city staff has requested that the contact be funded only through June of 2003 in order to
judge local budget impacts before the 2003/2004 school year. The city of Minnetonka
has agreed to seek only half of the total fee for 2003 under this agreement with payment
due on May 1,2003. The amount requested to fund 14 percent of the costs for half a
year is $4,604.

LIAISON OFFICER SERVICES AGREEMENT
FOR DISTRICT #270
THIS AGREEMENT is made between the CITY OF MINNETONKA ("Minnetonka"),
14600 Minnetonka Blvd., Minnetonka, MN 55345, the CITY OF GOLDEN VALLEY
("Golden Valley"), 7800 Golden Valley Road, Golden Valley, MN 55427, the CITY OF
HOPKINS ("Hopkins"), 1010 1 st Street South, Hopkins, MN 55343 and INDEPENDENT
SCHOOL DISTRICT NO. 270 ("School District"), 1001 Highway 7, Hopkins, MN 55343.
All Cities and the School District believe that a Junior and Senior High School Liaison
Officer Program ("the Program") continues to be needed to improve understanding and
promote mutual respect between police, school, staff, counselors, parents and students.
The Cities and School District wish to set forth in writing the terms and conditions of
their joint participation in providing the Program. This agreement is made under
authority of Minn. Stat. Sec. 471.59.
Therefore, in return for the mutual agreement set forth below, the parties agree as
follows:
1. TERM
The term of this agreement is for January 1,2003 through December 31, 2003,
unless terminated earlier as provided below.
2.
SERVICES
Minnetonka will provide the services of three police officers and related support
services and supplies to provide the Hopkins School District with a Junior and
Senior High School Liaison Officer Program. The officers will have primary
responsibility in serving as a resource persons to faculty, classroom members
and school administrators in the prevention and diversion of juvenile delinquency
behavior. Minnetonka agrees to provide fringe benefits, vehicle, fuel,
maintenance and other equipment as deemed necessary by the Chief of Police
for this program. The School District agrees to provide adequate office space,
telephone and other reasonable office support services.
3. TRAINING
As deemed appropriate by the Chief of Police, Minnetonka will provide the Junior
and Senior High School Liaison Officers with training according to the needs of
the Program described in this agreement. The School District may also provide
training, as conditions require. Minnetonka agrees to provide this training without
charge unless otherwise mutually agreed upon.

4.
PAYMENT
The parties will share the cost of the services provided for the 2003 calendar
year as follows:

Golden Valley and School District will pay their shares to Minnetonka in two
equal payments on May 1 and September 1 of 2003. Hopkins will make a
payment of $ 4,604 on May 1,2003.
5. SUPERVISION
Minnetonka agrees to provide supervision for the Junior and Senior High School
Liaison Officers who will remain employees of Minnetonka. The Junior and
Senior High School Liaison Officers may also receive work direction during the
school year from designated school staff members.
6.
RECORDS
Minnetonka agrees to maintain such records as are necessary to document that
the services are provided as represented by Minnetonka.
7. SCHEDULING
The duty hours of the Junior and Senior High School Liaison Officers are flexible
and will be primarily coordinated with school activities. The officers will make
daily contact with the police department for the purpose of keeping abreast of
incident' reports and other Minnetonka-wide activity. During non-school periods,
the officers' duty hours and duties will be determined by Minnetonka.
8. DISCRIMINATION
Minnetonka agrees not to discriminate in providing services under this agreement
on the basis of race, sex, creed, national origin, age, or religion.
9.
INSURANCE
Minnetonka agrees that it will, at all times during the terms of this agreement,
have and keep in force, worker's compensation benefits and other insurance
coverage for the Junior and Senior High School Liaison Officers as provided to
other Minnetonka police officer employees.

10. ENTIRE AGREEMENT
The entire agreement of the parties is contained in this document. The
agreement supersedes all oral agreements and negotiations between parties
relating to the Junior and Senior High School Liaison Officer Program and the
subject matter of this agreement. Any alterations, amendments, deletions, or
waivers of any provisions of this agreement are valid only when placed in writing
and signed by participating Cities and School District representatives. This
agreement may be re-negotiated if there is a change in the statutory laws, which
would affect funding for these positions.
11. INDEPENDENT CONTRACTOR
Nothing in this agreement is intended, nor may be construed to create the
relationship of partners or employer/employee relationships between
Minnetonka, Hopkins, Golden Valley and School District.
