CONDITIONAL USE PERMIT - ELKS LODGE
Proposed Action.
Staff recommends the following motion: Move to adopt Resolution 03-12, approvmg a
conditional use permit to construct a new Elks Lodge building.
At the Zoning and PI31ming meeting, Ms. Halverson moved and Ms. Allen seconded a
motion to adopt Resolution RZ03-2, recommending approval of a conditional use permit to
construct a new Elks Lodge building. The motion was approved unanimously.
Overview.
The applicant, the Elks Lodge, is proposing to construct a new building north of the existing
Elks Lodge building, The existing building will be razed and a new building constructed on
the vacant lot and parking area. The new building will be a one-story 70' x 115' with a
basement. The basement will be available to rent for receptions. The area where the existing
building is located will be the new parking area.
The entrance to the building will be on the south side from the parking area; there will be no
entrance from Eighth A venue. There will be a sidewalk on the south side of the building
from the sidewalk on Eighth Avenue and the alley to the west.
The Elks Lodge has also requested a zoning amendment to allow clubs on the first floor in
the B-2 district and a preliminary/final plat.

Primary Issues to Consider.
. What is the zoning of the property, and how has the Comprehensive Plan
designated the subject site?
The zoning of the property is B-2, and the Comprehensive Plan has designated the site as
commerciaL A club is a conditional use within the B-2 zoning district.
. What are the specifics of the development?
Landscaping
Landscaping is not required in the B-2 zoning districts; however, the site plan indicates
landscaping along the east and south sides of the building. There will be four trees removed
from the vacant site. Three of these trees will be located on the west side of the site. The site
plan indicates the fourth tree will be relocated on the boulevard. The relocation of this tree
will need approval from the public works department. It appears that the plantings on the
east slde of the building are on the boulevard. If this is the case, the plantings will have to be
moved onto the site.
Public Works
The public works department has reviewed the plans and has given comments to the
applicant. Any approvals should be conditioned upon approval by the public works
depmiment of the final drainage, utility, and grading plans.
Fire Marshal
The Fire Marshal has reviewed the preliminary plans and found them acceptable.
Parking
Parking is not required in the B-2 zoning district. The site does have a parking area on the
south side of the site. There are 26 parking spaces in the new lot. The Elks Lodge also has
reciprocal parking with the site on the south side of their site. There are 33 spaces on the
parking area to the south. The Elks Lodge will also be able to use the west parking area on
Park Nicollet's site.
Trash
The trash area will be located on the inside of the building.
Sidewalk
The existing sidewalk on Eighth Avenue will remain.

Access
Access to the parking area will be from Eighth Avenue and from the alley on the west side.
The existing curb cut on Eighth Avenue will be removed and sidewalk and curb and gutter
will be added.
Access into the building will be on the south side. There will be two doors to the Lodge on
this side, one for the main floor and a second for the lower level.
Exterior
The exterior will be rock face and scored concrete masonry units. At this time the color of
the block is not known by the Elks. Staff is recommending that it be an earth-tone color as
recommended in the design review guidelines.
Interior
.
The proposed building will have a lower level. This lower level will be available for rental
for receptions. There will be a seating capacity of 302 seats in the basement. In addition to
the dining area in the lower level, there will be three offices and an area for the Lodge. The
first floor will have a dining area and bar. The kitchen will be located on the first floor. The
new building will be ADA accessible, which the existing Elks building is not.

The north side has a one-foot setback. The ordinance does allow a zero setback, but the
applicant should have an easement from the abutting property owner for maintenance with
only a one-foot setback.
Surrounding uses
The site is surrounded by a parking lot on the north, and commercial uses on the east, south
and west sides.

Does the proposed building meet the proposed design standards?
The first plan submitted plan by the Elks Lodge did not meet the design standards. The Elks
were given the design standards, and the plans were amended to add larger windows, and

awnings were added on the Eighth A venue side. The signage on Eighth Avenue was also
changed.
· What was the discussion at the Zoning and Planning Commission meeting?
Ms. Anderson reviewed the new building with the Commission. Jeff Holle and Mark Olson
appeared representing the Elks. Mr. Holle reviewed the interior plans with the Commission.
It was noted that there is a national convention for the Elks in 2004, and this Elks Lodge is
the closest to the downtown Minneapolis area. The Commission did discuss the parking and
the additional parking that will be available at Park Nicollet Clinic to the south. There will
be a fonnal agreement with Park Nicollet and the Elks Club regarding this parking. No one
appeared at the public hearing regarding this item.
Alternatives.
1. Approve the conditional use permit to construct a new Elks Lodge. By approving the
conditional use pennit, the applicant will be able to construct the building as proposed.

2. Deny the conditional use permit to construct a new Elks Lodge. By denying the
conditional llse pem1it to construct a new Elks Lodge, the Elks will not be able to
constmct the building as proposed. If the City Council considers this alternative, findings
will have to be identified that support this alternative.
J. Continue for further information. If the City Council indicates that fwiher infoffilation is
needed, the item should be continued.

RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING A CONDITIONAL USE PERMIT TO CONSTRUCT A NEW ELKS LODGE
WHEREAS, an application for Conditional Use Permit CUP03-l has been made by the
Elks Lodge;
WHEREAS, the procedural history of the application is as follows:
1. That an application for a conditional use permit was made by the Elks
Lodge on December 27, 2002;
2. That the Hopkins Zoning and Plmming Commission, pursuant to mailed
and published notice, held a public hearing on the application and
reviewed sllch application on January 28, 2003: all persons present were
given an opportunity to be heard;
3.
That the written comments and analysis of City staff were considered; and
4.
A legal description of the subject property is as follows:
Lots 10, 11 and 12, Block 4 West Miill1eapolis
NOW, THEREFORE, BE IT RESOLVED that the application for Conditional Use
Pem1it CUP03-1 is hereby approved based on the following Findings of Fact:
I. That the proposed use meets the requirements for a conditional use permit.
BE IT FURTHER RESOLVED that application for Conditional Use Pem1it CUP03-1 is
hereby approved subject to the following conditions:
1. That the watershed district approves the proposed development.
2. That the tree on the boulevard is acceptable to the public works department.
3. That the public works department approves the final drainage, utility and grading
plans.
4. That the landscaping on the east side of the building is on the applicant's property.
5. That the applicant has an easement from the abutting property owner to the north for
access and maintenance to the building.
6. That the exterior of the building is an earth-tone color.
7. That there is a reciprocal parking agreement between Park Nicollet and the Elks
Lodge for parking and that this agreement is given to the City.
