CR 03-023 Plat-elks lodge . . . CITY OF ~ HOPKINS January 29,2003 Council Report CR03-23 PRELIMINARY/FINAL PLAT - ELKS LODGE Proposed Action. Staff recommends the following motion: Move to adopt Resolution 03-13, approvmg a preliminary/final plat for 30 Eighth Avenue South. At the Zoning and Planning meeting, Mr. Szuba moved and Mr. Halverson seconded a motion to adopt Resolution RZ03-3, recommending approval of a preliminary/final plat for 30 Eighth Avenue South. The motion was approved unanimously. Overview. The applicant, the Elks Lodge, is proposing to construct a building on the north side of their existing building. The existing site is currently three lots. The applicant is proposing to construct a 70' x 115' building on part of the parking area and a vacant area on Eighth Avenue South, north ofthe existing building. The subject lots are 50'x 130' and will become one 150' x 130' lot. In order for the applicant to construct the building, the lots will have to be re-platted to combine the lots into one. The building code will not allow a lot line to run through a building. Primary Issues to Consider. · What is the zoning of the property, and how has the Comprehensive Plan designated the subject site? The zoning of the prope11y is B-2. The Comprehensive Plan has designated the site as Commercial. The zoning and the land use comply with the proposed use. . Do the lots meet the zoning requirements? There is not a minimum lot size in a B-2 district. The proposed lot will be 150' x 130'. The lot as proposed meets the zoning requirements. · What are the specifics of the plat? The lots will be combined into one lot. . Does the proposed plat meet the subdivision requirements? The proposed plat meets the subdivision requirements. . . Will a park dedication fee be required? A park dedication fee will be required when the building permit is issued. · What was the discussion at the Zoning and Planning meeting? Ms. Anderson reviewed the reasons for re-platting the property. No one appeared at the public hearing regarding this item. Alternatives. ] . Approve the preliminary/final plat. By approving the preliminary/final plat, the applicant will be able to construct the building as proposed. 2. Deny the preliminary/final plat. By denying the preliminary/final plat, the applicant will not be able to construct the building as proposed. If the City Council considers this alternative, findings will have to be identified that support this alternative. 3. Continue for further infonnation. If the City Council indicates that further information is needed, the item should be continued. . . . . CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 03-13 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A PRELIMINARY/FINAL PLAT FOR THE ELKS LODGE WHEREAS, an application for a preliminary/final plat SUBD03-1 has been made by the Elks Lodge; WHEREAS, the procedural history of the application is as follows: 1. That an application for a preliminary/final plat was made by the Elks Lodge on December 27,2002; 2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on January 28, 2003: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of City staff were considered; and 4. A legal description of the subject property is as follows: Lots 10, 11 and 12, Block 4 West Minneapolis NOW, THEREFORE, BE IT RESOLVED that the application for a preliminary/final plat SUBD03-1 is hereby approved based on the following Findings of Fact: 1. That the preliminary/final plat meets the subdivision requirements. BE IT FURTHER RESOLVED that application for a preliminary/final plat SUBD03-1 is hereby approved subject to the following conditions: 1. That the park dedication fee is paid.
