Staff recommends adoption of the following motion: Move that Council adopt Resolution 2019-006, awardin� construction contracts and authorizin� assi�nment of contracts to Kraus-Anderson Construction — City Hall Remodel �roiect. Overview. A bid opening was held on Thursday, December 20 for the City Hall Remodel project. There was good bidder interest in our project and all 3 bid categories of work received multiple bids. Additionally, also on December 20, Kraus-Anderson Construction received quotes on the other 23, smaller work categories. Kraus-Anderson Construction has completed their bids and quotes analysis and has provided recommendations for award — see attached letter. Staff is requesting that City Council adopt Resolution 2019-006, which awards each of the consfruction contracts and also assigns these contracts, with the exception of the contract for work category 26-A, to the City's construction manager, Kraus-Anderson Construction. The assignment of contracts will be via an Assignment of Prime Contracts document, which is exhibit B to the resolution. In accordance with our agreement with Kraus-Anderson Construction, they are acting as Construction Manager — At Risk for the City and, as such, have submitted a guaranteed maximum price for this project at $3,197,805.00. The low bidder for this work, Laketown Electric Corporation is a non-union contractor. Kraus-Anderson Construction Company is a union company and, as such, they cannot hold the contract of a non-union contractor. Therefore, Kraus- Anderson will act as Construction Manager — Advisor (CM-A) in regards to this contract. As the CM-A, Kraus-Anderson is still required to oversee and manage this work along with all the other contracts, but they will not hold the contract and the City will pay this contractor directly, not through K-A. This is not a unique situation for K-A as they do manage public construction projects which may include both union and non-union contractors. • Breakdown of Total Project Costs o see attached overall project budget sheet o Total Project Cost = $4,857,179.00 • Project Schedule o Construction start: March 4, 2019 o Construction complete: August 30, 2019 o There will be site prep work and asbestos abatement work which will precede the March 4 construction start CITY OF HOPHINS, MINNESOTA RESOLiJTION NO. 2019-006 A RESOLUTION AWARDING AND AUTHORIZING ASSIGNMENT OF CONSTRUCTION CONTRACTS FOR THE HOPHINS CITY HALL REMODEL PROJECT WHEREAS, the city of Hopkins (the "Ciry") has worked with Wold Architect and Engineers and Kraus-Anderson Construction Company ("Kraus-Anderson") on design plans and specifications for the remodel of the Hopkins City Hall (the "Project"); and WHEREAS, on July 17, 2018, the City hired Kraus-Anderson as its construction manager for the Project; and WHEREAS, pursuant to an advertisement for bids for the Project, bids were received for 3 bid categories, opened, and tabulated according to law; and WHEREAS, price quotations were also obtained for quote categories, according to law; and WHEREAS, at this time, Kraus-Anderson is recommending the award and assignment of prime contracts, as related to the bid categories and the quote categories contained in the attached Exlubit A, in each respective category. NOW, TI�REFORE, BE TT RESOLVED BY TI� CITY COUNCIi, OF Ti� CTTY OF HOPKINS AS FOLLOWS: 1. The recitals set forth in the preamble to this Resolution and the exhibits attached to this Resolution are incorporated into this Resolution as if fully set forth herein. 2. Each prime contract recoxnmended by Kraus-Anderson, as contained in Exhibit A attached hereto, is hereby awarded. 3. Concurrent with contract award, the City Council further approves the assignment of said pri.me contracts to Kraus-Anderson, and the mayor and the city manager are thereafter authorized to effectuate said assignment by executing the Assignment of Prime Contracts document in the form contained in Exhibit B attached hereto. RECTTALS A. The Owner and the Contractor entered into an Award and Contract dated , 2018 (the "Agreement") in relation to work for a portion of the Hopkins City Hall Project at 1010 First Street South in Hopkins, Minnesota (the "Project"). B. The Owner entered into that certain agreement entitled Standard Form of Agreement between Owner and Construction Manager, A133T"�2009, as modifed and A201-2007, as modified, dated July 17, 2018 ("CM Agreement") regarding the Project with Kraus-Anderson Construction Company "(the Construction Manager"), which includes the Construction Manager's right therein to propose to the City a Guaranteed Maximum Price ("GMP") to carry out its services as a CM at risk with a GMP. C. The Agreement indicates the intent and the understanding of Owner and Contractor that the Agreement will be assigned to the Construction Manager. D. Both the Agreement and the CM Agreement allow the assignment of the Agreement by the Owner to the Construction Manager. NOW, THEREFORE, in consideration of the foregoing recitals and other good and valuable consideration, the receipt and sufficiency of which is hereby aclrnowledged, the parties hereto hereby agree as follows: 1. The Recitals are made a part of this Assignxnent. 2. Except for the rights and obligations reserved to Owner in Section 3 below, the Owner hereby assigns, transfers and sets over unto the construction manager for the Project, Kraus- Anderson Construction Company (the "Construction Manager"), all of the Owner's rights, beneiits, remedies, duties, obligations, title and interest in and under the Agreement for the Construction Manager's benefit in completing the Project. 3. Owner retains its continued ownership in the Project and land, the right to enforce all City- issued permits and City ordinances relevant to the Project, and all police power authority over the Project area and persons working in or affected by the Project. 4. The Contractor consents to the Assignment of the Agreement to the Construction Manager. The Contractor shall execute the Subcontract attached hereto as Exhibit 1(as such term is defined in the Agreement) or, if applicable, the Standard Contract Agreement for Materials Only (the "Material Contract"), attached hereto as Exhibit 2. The Contractor shall execute the Subcontract or, if applicable, the Material Contract, contemporaneously with this Assignment.
