RESOLUTION DECLARING A VACANCY ON THE HOPKINS CITY COUNCIL
Proposed Action.
Staff recommends that the Council approve the following motion: Approve Resolution 2019-014
Declaring a Vacancy on the Hopkins City Council.
This action will allow the City Council to move ahead with the appointment of a Council
Member to replace the vacant seat left by Mayor Cummings.
Overview:
Mayor Molly Cummings was elected to a two-year starting January 2, 2018. Mayor Cummings
has resigned from that position effective March 5, 2019 at 11:59 p.m. The City Charter requires
the City Council shall by resolution declare a vacancy to exist and shall appoint an eligible
person to fill the same.
As the appointed Mayor Pro Tempore Council Member Halverson will serve as the presiding
officer and Acting Mayor. It is anticipated that the City Council will appoint a Mayor at a
Special Meeting on March 6, 2019. The appointed Mayor will be given the oath of office
immediately after the appointment. Because there are less than two years remaining in the
original term of office, a special election is not required. The election of Mayor will be held in
conjunction with the regular municipal election on November 5, 2019. The terms of all Council
Members in charter cities expire on the first Monday in January. Whoever is elected to this two-
year term would be sworn into on office on January 7, 2020.

RESOLUTION DECLARING A VACANCY ON THE HOPKINS CITY COUNCIL
WHEREAS, Molly Cummings was elected to a two-year term as Mayor of the City of Hopkins
on November 7, 2017; and
WHEREAS, Mayor Molly Cummings has resigned from that position effective March 5, 2019
at 11:59 p.m.; and
WHEREAS, There are less than two years remaining in the term; and
WHEREAS, Section 2.05 of the Hopkins Charter provides that the City Council shall by
resolution declare the City Council seat vacant.
NOW, THEREFORE BE IT RESOLOVED, the City Council of the City of Hopkins hereby
declares a vacancy on the City Council effective March 5, 2019 at 11:59 p.m.

On Monday, February 25, 2019, I was appointed by Governor Tim Walz to represent District 5 on the
Metropolitan Council. I am pleased to accept this appointment. As required, “due to the incompatibility of
office doctrine,” I will resign my role as Mayor of the City of Hopkins, effective at 11:59 p.m. on Tuesday,
March 5, 2019, as I will be sworn in to the Metropolitan Council on Wednesday, March 6, 2019.
