MARCH 5, 2019
CALL TO ORDER
Pursuant to due call and notice thereof a regular meeting of the Hopkins City Council
was held on Tuesday, March 5, 2019 at 7:05 p.m. in the Fire Training Room at the
Hopkins Fire Station, 101 17t�' Avenue South.
Mayor Cummings called the meeting to order with Council Members Gadd, Halverson,
Hunke and Kuznia attending. Staff present included City Manager Mornson, Assistant
City Manager Lenz, City Clerk Domeier, City Attorney Riggs, Director of Public Works
Stadler, Director of Planning and Economic Development Elverum and City Planner
Lindahl.
ADOPT AGENDA
Motion by Kuznia. Second by Hunke.
Motion to Adopt the Agenda.

CONSENT AGENDA
Council Member Hunke questioned the process for Item 7 Adopt Resolution 2019-015
Approving Execution of a Hennepin County Healthy Tree Canopy Grant Agreement.
Director of Public Works Stadler provided the proposed phasing and project.

NEW BUSINESS
VI1.1. First Reading: Auto Related Uses Zoning Code Text Amendment; Lindahl
City Planner Lindahl provided a summary of the information provided in City Council
Report 2019-026. The zoning amendments were initiated by staff in response to code
enforcement complaints and a study of auto related uses in Hopkins.
Linda McGinty with the Luther Companies addressed the City Council regarding the
building to parking display ratio. Mr. Lindahl explained that the standard has been in
place since 1990. In that time Luther Companies has relocated their business and the
new location does not meet the requirement; however, the use was allowed under a
Planned Unit Development (PUD) process.
Mayor Cummings questioned if not changing the standard would affect Luther
Companies current business. Mr. Lindahl replied that they are the only auto sales
location with the BP district and the current standards do not apply. Ms. McGinty
expressed concerns about future development on another property. Mr. Lindahl noted
that it would be reviewed at the time of development.
Nand Mehra with Walser companies addressed the City Council regarding the building
to parking display ratio, outdoor storage and vehicle parking or display. Mr. Mehra
requested that language be added "related to sales and service business" allowed for
storage purposes.
Council Member Kunzia thanked staff for their work on the ordinance. Mayor
Cummings questioned the Planning Commission approval. Mr. Lindahl shared the
comments and revisions that were discussed and approved by the Planning
Commission.

Motion to Adopt Resolution 2019-017 approving the first reading of Ordinance
2019-1138 amending the City Code related to auto uses.

VI1.2. First Reading: Downtown Overlay District Rezoning; Lindahl
City Planner Lindahl provided a summary of the information provided in City Council
Report 2019-027. The rezoning was initiated by staff to make zoning classifications
consistent in the code.
Council Member Hunke thanked staff for defining the carryout food and allowing the
bike sales. He questioned the health club definition and uses. Mr. Lindahl stated the
definition and uses will cleaned up with the ordinance codification. Council Member

Gadd appreciated that the consistency was created in the zoning districts. Mayor
Cummings questioned if the changes met recent concerns. Mr. Lindahl replied yes.
The second reading of the item is scheduled for March 19, 2019.

Motion to Adopt Resolution 2019-018 approving the first reading of Ordinance
2019-1139 rezoning all properties within the Downtown Overlay District currently
zoned B-3, General Commercial District to B-2, Central Business District.

Nays: None. Motion carried.
VI1.3. Conditional Use Permit to Allow a Private High School Use in a Residential
Zone; Lindahl
City Planner Lindahl provided a summary of the information provided in City Council
Report 2019-025. St. Gabriel Church has requested approval of a conditional use
permit to allow operation of the Chesterton Academy in the existing school portion of the
St. Joseph Church campus at 1310 Mainstreet.
Motion by Hunke. Second by Gadd.
Motion to Adopt Resolution 2019-016, Approving a Conditional Use Permit for
St. Gabriel Church to private high school (the Chesterton Academy) within a
residential zone, subject to conditions.
Ayes: Cummings, Gadd, Halverson, Hunke, Kuznia
Nays: None. Motion carried.
VI1.4 Resolution Declaring a Vacancy on the Hopkins City Council; Domeier
Mayor Cummings shared that she was appointed to the Met Council. She officially
resigns as Mayor effective 11:59 p.m. on Tuesday, March 5.
City Clerk Domeier provided a summary of the information provided in City Council
Report 2019-022. The City Council will hold a Special Meeting on Wednesday, March 6
at 5:00 p.m. to discuss the transition plan and potentially appoint a mayor and declare a
vacancy on the City Council.
Council Member Halverson thanked Mayor Cumming for her service to the community.
Director of Public Works Stadler also thanked Mayor Cummings for supporting the
Public Works Department.

ADJOURNMENT
There being no further business to come before the City Council and upon a motion by
Kuznia, second by Gadd, the meeting was unanimously adjourned at 8:12 p.m.
