Stadler, Public Works Director c.--oU./ Copy: Rick Getschow, City Manager Date: January 19, 2006 Subject: Assessment Policy Discussion Purpose To present and explain the city's assessment policy, particularly how staff proposes to apply it to the 2006 street/utility improvement project. Staff thought this would be helpful as there are two new City Council members plus the 2006 project has a couple unique features that, in part, led to the staff recommendation on how to apply the assessment policy to this project. The Public Hearing is set for February 7. This is the hearing where City Council takes resident comments and considers whether or not to proceed with final design on the project. If City Council does order final design on the project, a pending assessment is recorded against each affected property. Additional future City Council actions include: . Approve final design & order bids . Accept bids and order assessment hearing . Assessment Hearing . Award contract Backaround The current assessment policy was established in 1987. It has been used on many street reconstruction projects over the past 18 years. The city has had an assessable street improvement project every year since at least 1995. The attached assessment policy summary lists the major elements of the current policy. 2006 StreeUUtilitv proiect assessments The recommended assessment method resulted from several unique features and encompasses different elements of the policy, including: . assessments based on front footages . assessments based on per unit or per property cost . street assessments to properties not served by the street, Le., assessments to 1ih Avenue properties for 1st Street South improvements . capped and non-capped assessment amounts . assessments to properties not fronting the improvements, i.e., the four properties at the south ends of 18th and 19th Avenues fronting on the cul-de-sacs . Mainstreet commercial properties Per unit assessments vs. front footage-based assessments . It is unusual for staff to recommend two different assessment methods for properties along the same avenue. Normally, we would use the front footage method for all the properties along 18th, 19th and 20th Avenues. However, we didn't feel it was proper to recommend an assessment based on front footage for the four properties on the 18th and 19th Avenue cul-de-sacs where the 2006 improvements don't front their properties. In this case, we felt that: 1) because these properties did not get assessed for the construction of the cul-de-sacs in 1998 and 2) staff felt that these properties benefit no less from the street improvements than the other neighborhood properties. The fairest method was to assign equal (unit) benefiUequal assessment to each property. This can result in some concern because, for instance, the 70' frontage properties along 19th Avenue pay the same assessment amount as the 80' frontage properties. Nevertheless, staff feels this is the fairest assessment method in this unique situation. . Staff considered assessing the entire area on a unit basis and City Council could decide to do that. It wouldn't be unreasonable as a vast majority of the front footages are either 75' or 80'. However, there are two properties on 19th Avenue (40 and 44 19th Avenue) that have 50' and 47' front footage, respectively, and a unit method would result in a much higher assessment than the actual front footage method. Assessments to properties along 1ih Avenue, not fronting or directly served by the street or avenues . This is a similar situation to the 2003 street improvement project where we assessed properties along 5th Avenue (from 1st to 3'd Streets North) for improvements to 2nd Street North between 5th and 6th Avenues. A difference here is that there are no improvements being made to 1ih Avenue whereas with the 2003 project 5th Avenue was improved. This assessment formula is based on the city policy as it describes side street assessments in the rectangular block areas of the city. Capped and non-capped assessment amounts . An assessment cap is being proposed for all residential properties, including the Oaks of Mainstreet town home prope~. However, the Mainstreet commercial properties that have frontage along 18 h Avenue, Le., Dairy Queen and KFC, and Tuttle's Bowl along 20th Avenue are being assessed at the full 70% assessment rate. This is consistent with how we applied the assessment policy in 2005 when we used the cap for the Regency properties but assessed ABM the full 70% rate for their frontage along Monroe Avenue. Mainstreet commercial properties . These properties (DQ and KFC) are not being assessed for the 1st Street South improvements. Staff used the east-west alley on the south side of Mainstreet as the cut-off for spreading the side street assessment. They are being assessed at the non-capped rate for only the 18th Avenue frontage. The 19th Avenue commercial property is not being assessed as the improvements do not extend north of the alley HOPKINS ASSESSMENT POLICY SUMMARY LEGISLATIVE POLICY 8B, ROADWAY IMPROVEMENTS (Council Work Session 1/24/06) GENERAL -Current policy established in 1987 -Assessment process follows State Statutes, Chapter 429 - City Council actions, public hearings, public notices - Assessment amount must bear a direct relationship to the value of the benefits the property receives, i.e., increased market value of the property - City cannot issue improvement bonds without a referendum unless at least 20% of the project cost is defrayed by special assessments ASSESSMENT POLICY SUMMARY -Major streets defined - Serve local and traffic from other areas - Constructed to 9 ton capacity - Curb and gutter required - Funding sources: general fund, special assessments and Municipal State Aid (MSA) funds -Local streets defined - Serve a small area - Constructed to minimum 7 ton capacity - Curb and gutter policy explained - Street and alley standards -Assessments -Adjusted front footage method, per lot unit method -Total project costs defined -New streets/utilities -Reconstruction -Alleys -Knollwood Pond improvements -Assessments for full or partial reconstruction -Existing local or major street: 70% of total project cost assessed -When major street is partially funded by MSA to improve design and capacity then assess based on cost of an average street construction -Special rules for single-family property on major streets: assess based on 'Y2 the cost of a standard local street as if built at the time of the assessment -Listing of items that are assessable as a part of a reconstruction project -Assessment formulas defined: front footage methods, unit method, rectangular block areas, odd-shaped lot areas - In unique cases Staff is allowed to recommend alternatives based on a "fair" comparison to other assessed properties - Deferral of assessments - Authorized by City Code Section 703 - For homestead property owned by a person 65 years old + or retired by virtue of a permanent and total disability and City Council determines it would be a hardship for owner to make payments. Income shall not exceed $29,400 (2003, annually- adjusted). Deferred assessments accrue simple interest. MAJOR CHANGES TO THE ASSESSMENT POLICY -Multiple assessments (2004): Sets a maximum of two concurrent assessments to any single family property within any 1 O-year period.
