Subordinate Funding Agreement 09 – Southwest LRT (Siren Relocation); ElverumOctober 6, 2020 Council Report 2020-071 SUBORDINATE FUNDING AGREEMENT 09– SOUTHWEST LRT (SIREN RELOCATION) Proposed Action Staff recommends adoption of the following motion: Move to approve Subordinate Funding Agreement (SFA 09) between the City of Hopkins and the Metropolitan Council. With this motion the Subordinate Funding Agreement will be executed. Overview As part of the construction of SW LRT, a weather siren at 5th Street in Hopkins needed to be relocated. The Metropolitan Council agreed to pay the cost of relocation but the work was contracted by the City of Hopkins through the Fire Chief due to the City’s ownership of the siren. The bid for the cost of the work is $7,692. The agreement adds in a contingency of 4% bringing the total not to exceed amount to $8000. The work was scheduled to take place on September 14, 2020, so the date of the agreement reflects that date. The Subordinate Funding Agreement provides for the reimbursement to the City of Hopkins of the cost to relocate. Primary Issues to Consider The relocation of the siren was needed in order to facilitate construction of the SW LRT line, while maintaining a siren for emergency notification. WHEREAS: 1. The Parties entered into a Southwest Li ght Rail Transit Project (“Project”) Master Funding Agreement (“MFA”), effective January 29, 2015. 2. The Parties provided in the MFA that certain aspects of funding for the Project or components related to but not part of the Project would be determined in subsequent SFAs. 3. The Parties desire to enter into this Subordinate Funding Agreement in order to provide funding for the Project as described below. NOW, THEREFORE, in reliance on the statements in these recitals, the Parties hereb y agree as follows: 1. Maximum Amount of Authorized Funding. The cost for City activities authorized by this SFA shall not exceed $8,000.00 unless authorized in a subsequent agreement or an amendment to this SFA. 2. Project Budget. The budget for City activities described in this SFA is provided as Exhibit A. Council funds provided for this SFA may only be used for reimbursing the City’s costs for activities directly incurred within the described Specific Description of Funding Authorization and as detailed in the MFA. Page 2 of 5 3. Specific Description of Funding Authorization. The Council will reimburse the City for actual labor, material, and equipment costs related to the City’s relocation of the siren at 5th Street in the City of Hopkins. 4. Ownership of City of Hopkins Supplied Materials. The siren, which is the subject of this SFA, will be owned and maintained by the City during construction and shall continue to be owned and maintained by the City after the Project Activity Period. 5. Project Activity Period. The project activity period for the purposes of this SFA shall be effective September 14, 2020 and shall terminate on the date all costs under this SFA have been reimbursed, unless terminated earlier consistent with the terms of the MFA. 6. Vendor Agreement. This SFA, in conjunction with the MFA, constitutes a vendor agreement for the purposes of any federal grant funds passed through to the City hereby. 7. Incorporation. The terms, conditions, and definitions of the MFA are expressly incorporated into this SFA.
