CR 06-064 Comprehensive Plan Amendment 106 Jackson Ave CITY OF m HOPKINS May 31, 2006 Council Report 06-64 COMPREHENSIVE PLAN AMENDMENT - 106 JACKSON AVENUE ProDosed Action Staff recommends the following motion: Move to adopt Resolution 06-41. approving a Comprehensive Plan designation amendment from Industrial to Business Park at 106 Jackson Avenue. At and Zoning and Planning meeting, Ms. Hatcher moved and Mr. Skiermont seconded a motion to adopt Resolution RZ06-11, recommending approval of a Comprehensive Plan designation amendment from Industrial to Business Park at 106 Jackson Avenue. The motion was approved unanimously. Overview 106 Jackson Avenue is currently guided Industrial in the Comprehensive Plan. This property abuts the former Supervalu North Annex site. Opus Corporation is proposing to purchase the property to redevelop this site with the larger site. The former North Aunex site is presently zoned Business Park and guided Business Park. With this amendment to the Comprehensive Plan, both sites will have Business Park zoning and Comprehensive Plan designation. The former Supervalu site and 106 Jackson will have a PUD overlay zoning placed over the sites. Primarv Issues to Consider . How has the Comprehensive Plan designated the subject area? . How has the Comprehensive Plan designated the subject area? The Comprehensive Plan has designated the site as Industrial. There is a requirement that the Comprehensive Plan and zoning be consistent. With the proposed zoning change, the zoning and the Comprehensive Plan designation will be consistent. . What is the difference between the Industrial and Business Park designations? The primary use for Business Park zoning is an office use. The primary uses in an industrial zone are warehousing, manufacturing, and storage. . Should the 106 Jackson Avenue designation be changed? Because Opus has purchased 106 Jackson Avenue and will be incorporating the site into the larger site, it is logical to rezone the site to Business Park and amend the Comprehensive Plan to Business Park. . What was the discussion at the Zoning and Planning meeting? Ms. Anderson stated that amending the Comprehensive Plan was necessary when the property is rezoned. Dave Menke, representing Opus Corporation, reviewed the master plan with the Commission. Pete Stiehm of 307 Burnes Drive appeared at the public hearing and was concemed about the traffic on Second Street. Alternatives 1. Approve the Comprehensive Plan amendment. By approving the Comprehensive Plan amendment, the site can be redeveloped. 2. Deny the Comprehensive Plan amendment. By denying the Comprehensive Plan amendment, the site can not be redeveloped. If the zoning is changed and the Comprehensive Plan amendment is not approved, the zoning and Comprehensive Plan amendment will not be consistent. 3. Continue for further information. W~ r~~~:~~~~r.}~~;f;i:~~:: November 8. 1999 CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 06-41 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A COMPREHENSIVE PLAN AMENDMENT FOR 106 JACKSON AVENUE WHEREAS, an application for Zoning Amendment ZN06-5 has been made by Opus Corporation; WHEREAS, the procedural history of the application is as follows: 1. That an application for a Comprehensive Plan amendment was made by Opus Corporation on April 28, 2006; 2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on May 30, 2006: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of City staff were considered; and 4. A legal description of the subject property is as follows: Lots 11, 12, 13, and the easterly 16 feet of Lots 14 and 15, Block 4, West Minneapolis Center, Hennepin County, Minnesota NOW, THEREFORE, BE IT RESOLVED that the application for Comprehensive Plan Amendment ZN06-5 is hereby approved based on the following Findings of Fact: 1. That the amendment to the Comprehensive Plan will make the zoning and the land use plan consistent. BE IT FURTHER RESOLVED that application for Comprehensive Plan Amendment ZN06-5 is hereby approved based on the following conditions: 1. That the Metropolitan Council approves the proposed amendment.
