CR 06-057 Approve Supplemental Agreement Hopkins Crossroads/Minnetonka Blvd Intersection Improvement CiTY OF - May 12, 2006 HOPKINS Council Report 2006-057 Approve Supplemental Agreement - Hopkins Crossroads/Minnetonka Boulevard Intersection Improvements Proposed Action. Staff recommends adoption of the following motion: Move that Citv Council authorize the Mavor and Citv Manaqer to siqn a supplemental aqreement in the amount of $51,112.40 to amend the contract between Hennepin Countv and Park Construction Co. Overview. Subsequent to construction contract approval, staff determined that it would be beneficial to replace an additional 500' of 12" watermain that was located under existing storm sewer pipe and had leaked in the past. Park Construction Co. agreed to the additional watermain replacement at the original contract bid prices. Hennepin County has prepared the required supplemental agreement and Park Construction has signed it. Staff now requests City Council approval. CONTRACTOR: Park Construction Co. 500 73rd Ave. NE Suite 123 Minneapolis, MN 55432 This contract is amended as follows: WHEREAS: This contract provides for, among other things, grading, bituminous surfacing, curb and gutter, storm sewer, sanitary sewer, watermain, and signal systems, landscaping, and WHEREAS: Following the contract approval for this project, the City of Hopkins desires to extend its proposed 12" watermain replacement further south along CSAH 73 to approximate Sta. 49+50, and WHEREAS: Replacement of this watermain will also include the replacement ofthe existing hydrant and at approximate Sta. 49+57, and WHEREAS: The watermain extension will extend south of the proposed road improvements, and WHEREAS: Existing pavement disturbances outside of the road improvement area shall be minimized by the use of a trench box or other approved methods, and WHEREAS: Necessary temporary water services to two additional houses requires additional material and labor per service beyond that typical of the original contract temporary water service locations, and NOW THEREFORE IT IS MUTUALLY AGREED AS FOLLOWS: I. The contractor shall extend the 12" watermain replacement as illustrated in the attached sketch; all work being completed in accordance with the project specifications. I 2. The contractor shall supply all labor, materials, and equipment necessary to complete this work at the negotiated unit price shown in the Estimate of Cost below. 3. The contractor shall use a trench box or other approved methods to minimize existing pavement disturbances outside of the road improvement area. Payment for 12" watermain construction within this area is tabulated in the 12" WMN DIP, CI. 52 (SPEC) below. 4. The pavement section restoration over the trench, outside of the road improvement area, shall match that of the existing pavement section in this area. The remainder of the existing pavement surface adjacent to the trench shall be restored with a 1.5" mill and overlay. 5. The work performed will be measured and payment made in accordance with the units of measurement as shown in the Estimate of Cost which shall be compensation in full for all costs incidental thereto. 6. The contractor shall not make claim of any kind or character whatsoever for any other costs or expenses which he may have incurred or which he may hereafter incur in performing the work and furnishing the materials required by this agreement. 7. The contract time will not be revised except as may be provided under the contract provisions of MnlDOT specification 1806; 1906 does not apply. 8.
