COMPREHENSIVE PLAN AMENDMENT - CONDOS
Proposed Action.
Staff recolllmends the following motion: Move to adopt Resolution 04-26, approving a
Comprehensive Plan amendment from Institutional to High Density Multiple Family [or the
site north of the United Methodist Church.
At the Zoning and Planning meeting, Mr. Halverson moved and Mr. Paul seconded a motion
to adopt Resolution RZ04-6, recommending approval o[ a Comprehensive Plan amendment
from Institutional to High Density Multiple Family for the site north of the United Methodist
Church. The motion was approved unanimously.
Overview,
The applicant, Halley's Custom Homes, Inc., is proposing to construct 18 for-sale, one and
two-bedroom condos north of the United Methodist Church located on Highway 7, The
subject lot cUlTently has the church located on the south side and a parking lot on the north
side of the site. The church docs not need the additional parking, and it appears that their
parking can be accommodated on the south side of the site.
. The proposed building would be three stories and have underground and surface parking.
The condo price range will be from $350,000 to $500,000. The building will be marketed [or
residents 55 years of age nnd older.

. What is the difference between the Institutional and R-4 zonings?

. How has the Comprehensive Plan designated the subject site?
The Comprehensive Plan has designated the site as Institutional. There is a requirement that
the Comprehensive Plan and zoning be consistent. With the proposed zoning change, the
zoning and the Comprehensive Plan d~signation will be consistent.
. What is the difference between the Institutional and High Density Residential
designation? '
An Institutional zoning allows single;-family homes,and two-family homes as permitted uses,
Schools and religious institutions ~are allowed as conditional uses, The High Density
Residential designation is a high density multiple family building,
. Should the site north of the United Methodist Church Comprehensive Plan
designation be changed?
In looking at the area, the only logical change would be to amend the, Comprehensive Plan to
a multiple family designation. The, site. would not be a commercial, industrial or a single-
family area. There is an area owned 'by the golf course on the east side and then farther east
. is anapartment complex. To the north is the golf course, to the south the church, and to the
west the property is owned by the School District.
. What was the discussion at the Zoning and Planning meeting?
Ms. Anderson stated that the Comprehensive Plan ,and zoning have to be consistent, so the
Plan will have to be amended from Institutional to High Density Residential. No one
appeared at the public hearing regarding this issue. "
Alternatives,
1, Approve the Comprehensive Plan amendment. By approving the Comprehensive Plan
amendment, the zoning and qomprehensive Plan will be consistent.
2, Deny the Comprehensive Plan amendment. By denying the Comprehensive Plan
amendment, the zoning and. Comprehensive Plan will not be consistent. If the City
Council considers this altemdtive, findings will have to be identified that support this
alternative,
3. Continue for further information, If the City Council indicates that further
information is needed, the item should be continued.

WHEREAS, an application for Zoning Amendment ZN04-5 has been made by Mike
Halley;
WHEREAS, the procedural history of the application is as follows:

Halley on March 1,2.004;
2, That the Hopkins Zoning and Planning Commission, pursuant to mailed and
published notice, held a public hearing on the application and reviewed such
application on March: 30, 2004: all persons present were given an opportunity to
