CONDITIONAL USE PERMIT - WESTSIDE
Proposed Action.
Staff recommends the following motion: Move to adopt Resolution 04-88, approving a
conditional use pennit to erect a sign at Westside Apartments,
At the Zoning and Planning meeting Ms. Aristy moved and Mr. ShoHz seconded a motion to
approve Resolution RZ04-37, recommending approval of a conditional use pennlt to erect a
sign at Westside Apartments. The motion was approved unanimously.
Overview.
Now that the intersection of Blake and Excelsior is completed, Wests ide Apartments is
proposing to construct a new sign. Westside Apartments is located on the northeast side of
the intersection. The sign as proposed will identify the apartments. The proposed sign will
be a monument sign located on the comer of Blake and Excelsior.
e The site is zoned R-4. All signs over 12 square feet require a conditional use permit.

. Primary Issues to Consider.
. What is the zoning of the property, and how has the Comprehensive Plan
designated the subject site?
The propcliy is zoned R-4 PUD and the Comprehensive Plan has designated the property as
High Density Residential. The existing use confonns to both of these documents.
. What section of the ordinance requires a conditional use permit for the sign?
570.46 Conditional Use Pemlit R-Districts. Signs may be permitted by conditional use
permit for public parks and playgrounds, churches, synagogues, public libraries, public
museums, public and parochial schools, municipal buildings, golf courses, country clubs,
apartment buildings, nursing homes, community centers, colleges, universities and private
schools, hospitals, and sanitariums based on the following design criteria and other
conditions the City Council may require:
a) size: tbe size shall be proportional to the size of the facility, need for signing, frontage
on street(s), location, visibility, and development in the area. The maximum size
should not exceed 60 square feet per sign surface with a maximum area of 120 square
feet per single sign.
b) height: no freestanding sign shall exceed fifteen feet in height.
. c) lighting: (1) lighting shall be indirect or it shall be backlit (2) neon lighting, flashing
lighting, and/or rotating lighted signs shall be prohibited.
d) design: signs attached to buildings shall be integrated with building desib'11 and
architecture in terms of materials, colors, lighting and placement; signs not attached
to the building shall be architecturally treated and coordinated with the principal
building by use of compatible materials and design.
e) location: no freestanding signs shall be located less than five feet from any street
right-of-way line.
f) sign purpose: the principal purpose of the sign permitted under this section shall be to
identify the public or institutional use made of the property.
The sign as proposed meets the above requirements.
. What are the specifics of the sign'?
The proposed sign will be 12' x 2'10" or approximately 33.96 square feet. Below the sign
will be a phone number. The sign will be approximately six feet high. The sign will curve
with the comer and will be made of aluminum, It will be lit from the ground.
. What was the discussion at the Zoning and Planning meeting?
Ms. Anderson reviewed the proposed sign. Myrna Oresten of Imaginality appeared before
. the Commission. Ms, Orensten stated that they are putting the sign on the main comer of the
apartment complex. She stated that the old sign will be removed and there will also be new

. directional signage on the site. No one appeared at the public hearing.
Alternatives.
1. Recommend approval of the sign. By recommending approval of the sign, the City
Council will consider a recommendation of approval.
2. Recommend denial of the sign. By recommending denial of the sign, the City Council
will consider a recommendation of denial. If the Planning Commission considers this
altemative, findings will have to be identified that suppOli this alternative.
3. Continue for fUliher information. If the Planning Commission indicates that further
information is needed, the item should be continued.

RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING A CONDITIONAL USE PERMIT TO CONSTRUCT A SIGN
WHEREAS, an application for Conditional Use Pemlit CUP04-13 has been made by
Imaginality, Inc;
WHEREAS, the procedural history of the application is as follows:
1. That an application for a conditional use peml1t was made by Imaginality, Inc., on
October 15, 2004;
2. That the Hopkins Zoning and Plmming Commission, pursuant to mailed and
published notice, held a public hearing on the application and reviewed such
application on November 30, 2004: all persons present were given an oPPOliunity
to be heard;
3. That the written comments and analysis of City staff were considered; and
. 4. A legal description of the subject property is as follows:
That pati of lot 76 Auditors Subdivision No 239 lying West of the east 635
feet thereof and lying south of a line described as commencing at the
southwest corner of Ole east 635 feet of said lot.
NOW, THEREFORE, BE IT RESOLVED that the application for Conditional Use Pennit
CUP04-13 is hereby approved based on the following Findings of Fact:
1. That the sign meets the requirements for a conditional use pemlit.
BE IT FURTHER RESOLVED that application for a Conditional Use Pemlit CUP04-13 is
hereby approved subject to the following conditions:
1. That a new site plan is submitted indicating the setback.
