V ARlANCE - SIDE YARD SETBACK
Proposed Action.
Staff recommends the following motion: Move to adopt Resolution 04-91, approving a
side yard setback for the lot at 220 HOl11edale.
At the Zoning and Planning meeting Mr. Aamess moved and Ms. Aristy seconded a
motion to approve Resolution RZ04-39 recommending approval of a side yard setback
for the lot at 220 Homedalc. The motion was approved unanimously.
Overview.
The applicant, Amy Tickle, is proposing to rebuild her home on the same foundation at
220 Homedale. A fire destroyed the home this past spring, and all that remains is the
foundation. The existing south side yard setback is 9Y2 feet. The required side yard
setback for a two-story home in the R-I-C zoning district is 12 feet.
The existing foundation also does not have the required front yard setback of 30 feet. In
this case, however, a variance will not be required for the front yard setback because
there is a zoning code provision that allows the front yard setback to be equal to the
. distance of the average front yard setbacks of other homes on the block.

. What does the ordinance require'?
The side yard setback in the R-1-C zoning district for a two-story home is 12 feet.
. What are the specifics of the applicant's request'?
The applicant is requesting a variance of 2 1/2 feet.
. What special circumstances or hardship does the property have?
The Zoning Ordinance states the following: a variance is a modification or variation
from the provisions of this code granted by the board and applied to a specific parcel of
property because of undue hardship due to circumstances peculiar and unique to sLlch
parcel. The Zoning Ordinance also states the following: that the Commission must find
that the literal enforcement of the provision of the Zoning Ordinance would cause an
undue hardship because of circumstances unique to the individual prope11y under
consideration and that the granting of a variance to the extent necessary to compensate
for said hardship is in keeping with the intent of this code.
In this case, the applicant has an undue hardship that is unique to the property. The
. home was destroyed by a fire but the foundation remains and can be used again. The
garage is a tuck-under, and to move the foundation would create an undue hardship.
. What was the discussion at the Zoning and Planning meeting?
Ms. Anderson reviewed the proposed variance. Amy Tickle and Tom Bird appeared
before the Commission. Ms. Tickle stated that they are building a home that is very
similar to the home that was there.
Alternatives.
1. Approve the variance. By approving the variance, the applicant will be able to
construct the home as proposed.
2, Deny the variance. By denying the variance, the applicant will not be able to
construct the home as proposed. If the City Council considers this altemativc,
findings of fact will have to be stated that support this recommendation.
3. Continue for further infomlation. If the City Council indicates that further
information is needed, the item should be continued.

RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING A VARIANCE FOR A SIDE YARD SETBACK
WHEREAS, an application for Variance VN04-5 has been made by Amy Tickle; and
WHEREAS, the procedural history of the application is as follows:
1. That an application for Variance VN04-5 was made by Amy Tickle on
November 2, 2004;
2. That the Hopkins Zoning and Plmming Commission, pursuant to mailed
notice, held a meeting on the application and reviewed such application on
November 30, 2004: all persons present were given an opportunity to be
heard;
3. That the wlitten comments and analysis of the City staff were considered;
and
4. Legal description of the parcel is as follows:
Lots 24 & 25, Block II, F A Savage Interlachen Park
. NOW, THEREFORE, BE IT RESOLVED that application for Variance VN04-5 is
hereby approved based on the foJlowing Findings of Fact:
1. That the subject property was destroyed by a fire.
2. That the existing foundation for the south side yard is 9 1/2 feet fi'om the
south propel1y line.
3. That the applicant has a tuck-under garage, and to reconstruct the foundation
would create an undue hardship.
