CONDITIONAL USE PERMIT - OAK RIDGE PLACE SIGN
Proposed Action.
Staff recommends the following motion: Move to adopt Resolution 04-52, approving a
conditional use pemlit to erect a sign at Oak Ridge Place.
At the Zoning and Planning meeting, Mr. Paul moved and Mr. Sholtz seconded to adopt
Resolution RZ04-21, recommending approval of a conditional use pemlit to erect a sign at
Oak Ridge Place. The motion was approved unanimously.
Oyerview.
The new condos at Oak Ridge Place arc cunently under construction. These are the condos
that are located north of the Hopkins Methodist Church.
The proposed sign will be a monument sign located on the south side of the site, in the green
arca separating the church property from the condo property. The sign will have a ledgestone
base, and the sign will have 8" x 12" letters. The sign will be lit with indirect lighting from
the ground,

complexes are required to obtain a conditional use pel111it for a sign.

. Primary Issues to Consider.
. What is the zoning of the property, and how has the Comprehensive Plan
designated the subject site?
The property is zoned R-4 and the Comprehensive Plan has designated the property as High
Density Multiple Family. A conditional use pemlit is required for sib'11age greater than 12
square feet.
. What section of the ordinance requires a conditional use permit for the sign?
570.46 Conditional Use Permit R-Districts. Signs may be pennitted by conditional use
pelll1it for public parks and playgrounds, churches, synagogues, public libraries, public
museums, public and parochial schools, municipal buildings, golf courses, country clubs,
apaltment buildings, nursing homes, community centers, colleges, universities and private
schools, hospitals, and sanitariums based on the following design criteria and other
conditions the City Council may require:
a) Size: the size shall be proportional to the size of the facility, need for signing,
frontage on street(s), location, visibility, and development in the area. The maximum
size should not exceed 60 square feet per sign surface with a maximum area of 120
square feet per single sign.
. b) height: no freestanding sign shall exceed fifteen feet in height.
c) lighting: (1) lighting shall be indirect or it shall be backlit (2) neon lighting, flashing
lighting, and/or rotating lighted signs shall be prohibited.
d) design: signs attached to buildings shall be integrated with building design and
architecture in temlS of materials, colors, lighting and placement; signs not attached
to the building shall be architecturally treated and coordinated with the principal
building by use of compatible materials and design.
c) location: no freestanding signs shall be located less than five feet from any street
right-of-way line.

identify the public or institutional LIse made of the prope11y.
The sign as proposed meets the above requirements.
. What are the specifics of the sign?
The proposed sign will have a 20-foot ledgestone base and the area where the lettering will
be set is 12' long. The lettering on the sign is 2" x 8", the actual name will be approximately
14 square feet. The highest point of the sign is five feet where the ledgestone pillar will be
located. The sign will identify the condos at Oak Ridge Place.
. What was the discussion at the Zoning and Planning meeting?
. Ms. Anderson reviewed the proposed sign. Ms, Anderson also stated that the church has

. applied for a conditional use pe11nit for a new sign. The applicant, Mike Halley, appeareel
before the Commission. The Commission asked if the church sign would be problem. Mr.
Halley stated that the church sign would be approximately 150 feet to the east. No one
appeared at the public hearing regarding this item.
Alternatives.
1. Approve of the sign. By approving the sign, the applicant will be able to construct the
sign as proposed.
2, Deny the sign. By denying the sign, the applicant will not be able to constmct the sign as
proposed. If the City Council considers this alternative, findings will have to be
identified that suppOli this altemative.
3. Continue for further information. If the City Council indicates that further info111101tion is
needed, the item should be continued.

RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING A CONDITIONAL USE PERMIT TO CONSTRUCT A SIGN
WHEREAS, an application for Conditional Use Permit CUP04-7 has been made by Halley's
Custom Homes;
WHEREAS, the procedural history of the application is as follows:
1- That an application for a conditional use pennit was made by Halley's Custom
Homes on June 22, 2004;
2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and
published notice, held a public hearing on the application and reviewed such
application on July 27, 2004: all persons present were given an opportunity to be
heard;
3. That the written comments and analysis of City staff were considered; and
. 4. A legal description of the subject property is as follows:
Lot 1, Block 1, Oak Ridge Place
NOW, THEREFORE, BE IT RESOLVED that the application for Conditional Use Pennit
CUP04-7 hereby approved based on the following Findings of Fact:
1- That the sign meets the requirements for a conditional use permit.
