Staff recommends the following motion: Move to adopt Resolution 04-39. approving Ordinance 04-924. placing an overlay zoning ofPUD at 250 Fifth Avenue South for first reading. At the Zoning and Planning Commission meeting Mr. Kjos moved and Ms. Aristy seconded a motion to adopt Resolution RZ04-15, recommending approval of Ordinance 04-924, placing an overlay zoning ofPUD at 250 Fifth A venue South. The motion was approved unanimously. Overview. Hopkins Honda has purchased the former Knox site with plans to relocate the Honda facility to this site. This relocation will remove the entire Honda line from downtown Hopkins. Honda has outgrown the site at Fifth and Mainstreet, and this site will become a smaller franchis{:). The area occupied by Honda on Sixth and Seventh Avenues will be available for redevelopment. The former Knox site will allow .all of the Honda activity to be on one site. The new building will be oriented to the east for visibility from Highway 169. The main access point will be from . Fifth Avenue. . There are some environmental issues with the site, and there will be a clean-up process before construction of the building will be able to be started. Primary Issues to Consider. . What is the zoning of the property, and how has the Comprehensive Plan designated the subject site? The zoning of the property is Business Park. In order for this development to occur, the property will have an overlay rezoning of PUD. The Comprehensive Plan has designated this site as Business Park. The base zoning will remain, and Comprehensive Plan land use designation will remain. . Should the site have an overlay zoning of PUD? The overlay zoning of PUD will allow the auto sales use without changing the base zoning of Business Park. If in the future the auto sales lot discontinues its use, the ba.se zoning of Business Park will be the future use ofthe site. . Will the Comprehensive Plan be amended? The Land Use section of the Comprehensive Plan will be amended to allow an auto sales use on this site. . . What was the discussion at the Zoning and Planning Commission? Ms. Anderson' reviewed the reason for the overlay PUD zoning. Jeff Hagen appeared at the public hearing. Mr. Hagen was c.oncemed about the pylon sign and whether the sign would be too bright and have a negative affect on the Town Terrace apartments. Mr. Allison stated they have not determined the hours the sign would be illuminated. Alternatives. 1. Approve the overlay zoning of PUD. By approving the PUD overlay zoning, Hopkins Honda will be able to move to the former Knox site. 2. Deny the overlay zoning of PUD. By denying the PUD overlay zoning Hopkins Honda will not be able to move to the former Knox site; 3. Continue for further information. Hennepin County, Minnesota RESOLUTION NO: 04-39 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN ORDINANCE PLACING A PUD OVERLAY ZONING AT 250 FIFTH STREET SOUTH WHEREAS, an application for Zoning Amendment ZN04-7 has been made by The Luther Company Limited Partnership and Hopkins Real Estate, LLC; WHEREAS, the procedural history ofthe application is as follows: 1. That an application for zoning amendment was made by The Luther Company Limited Partnership and Hopkins Real Estate, LLC, on April 23, 2004; 2. That the Hopkins Zoning and Planning Commission published notice, held a public hearing on the application and reviewed such application on May 25, 2004: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of City staff were considered. . NOW, THEREFORE, BElT RESOLVED that the application for Zoning Amendment ZN04-7 is hereby approved based on the following Findings of Fact: 1. That the overlay rezoning is necessary to develop the property to an auto sales lot. BE IT FURTHER RESOLVED that application for Zoning Amendment ZN04-7 is hereby approved based on the following conditions: 1. That the Comprehensive Plan text is amended to allow auto sales on this site. 2. That the Conditional Use Permit is granted for the construction of the proposed development. 3.
