June 7, 2004 i Counci.1 Report 2004-092 : HOPKINS Contract for Services with Stages Theatre Company , " , Proposed Action Staff recommends adoption of the following motion: Move to approve the Contract For Professional Services with Staqes Theatre Company. ' Overview .. To cooperatively accomplish certain maintenance and facilityusage objectives at the Hopkins Centerfor the Arts, Stages Theatre Company (STC) an9 the City of Hopkins are entering, into a professional services agreement that is mutually beneficial to both parties. STC being an in-house tenant at the Arts Center brings the ability and willingness to perform certain preventative maintenance, repair, and custodial functions needed to maintain the level of service expected at the Arts Center; STC also will , release to the City, through this agreement, lease time that is in demand for use by occasional users of the facility thus making the facilitY more accessible to' the public. Primarvlssues to Consider . How will thetagreement benefit the City of Hopkins? The Arts Center has a .' staff of one custodian and five hours ofmaintenarice assistance per week. Additional assistance is needed to perform necessary preventative' maintenance; major cleaning projects, and repairs. This contract utilizes a , labor pool (STC personnel) that is very familiar with the facility arid City staff. This brings efficiency and access to a large labor pool to address the shortage of staff for custodial and maintenance tasks at the Arts Center. . tfow does this agreement benefit the facility users? BySTC releasing dates in the Theater, JCStudio"CommunityRbom, and Dance Studio there. is more' time available for community events, meetings, performances, etc. . How will the agreement be funded? CITY OF HOPKINS CONTRACT FOR PROFESSIONAL SERVICES ITIS HEREBY AGREED THAT, StaaesTheatre Company is to furnish services as herein stated for the CITY OF HOPKINS, MINNESOTA (City). It is further agreed that said services are to be rendered as an iQdependent contractor and not as an employee of the City. Accordingly, the above named contractor shall not be entitled to or receive any benefits, such as vacation or sick 'leave pay, pension and insurance contributions, or holiday or overtime pay. This agreement shall take effect upon its execution by both , parties and shall remain in effect until June 30; 2005 ,at which time it shall be automatically terminated. This agreement is subject to prior termination by the City by ten days notice, .in writing, to the contractor, delivered by first class .' SERVICES TO BE PERFORMED UNDER TERMS OF THIS AGREEMENT SHALL BE: Bi-monthly Theater seating inspection and repair,bi~annual painting of Theater proscenium, welding and repair of Art Center stackchairsand folding tables, Theater house lamp replacement, assist Art Center staff with summer window cleaning projects.
