VARIANCE - SIDE YARD SETBACK
Proposed Action,
Staff recommcnds the following motion: Move to adopt Resolution 04-35, approvin\.!, a
side yard setback for the lot at 236 Maple Hill Road.
At the Zoning and Planning mceting, Mr. Kjos moved and Ms, Aristy seconded a motion
to adopt Resolution RZ04-12, recommending approval of a side yard setback for the lot
at 236 Maple Hill Road, The motion was approved unanimously.
Overview.
The applicants, Christina and Gary Code, currently have a one-story home \\!ithoul a
basement at 236 Maple Hill Road. They would like to add a second story for additiollnl
space, The zoning ordinance in an R-I-C district requires a 12- foot side yard setback for
a two-story home, The existing home has a six-foot not1h side yard and a five-foot
south sideyard,
The zoning ordinance docs pennit a five-foot setback on the side where the garage is
located, The north side (garage side) will comply with the required setback. The south
side is \vhere the vari<lllce is requested, The south side of the home currently has a five-
. foot setback and would be required to have a 12-[00t setback for a t\VO-story home,
The property 011 the south side of the applicants' property is unique because it is a
driveway to a home west of the applicants' property. The abutting home is south of the
driveway.

The side yard setback for a two-story home in the R-1-C zoning district is 12 feet
. What are the specifics of the applicants' request?
The applicants' are requesting a variance of seven feet for the south side yard setback,
. What special circumstances or hardship does the property have'?
The Zoning Ordinance states the following: a variance is a modification or variation
fl'ol11 the provisions of this code granted by the board and applied to a specific parcel of
property because of undue hardship due to circumstances peculiar and unique to such
parcel. The Zoning Ordinance also states the following: that the Commission must find
that the literal enforcement of the provision of the Zoning Ordinance would cause an
undue hardship because of circumstances unique to the individual property under
consideration and that the granting of a variance to the extent necessary to compensate
for said hardship is in keeping with the intent of this code.
. In this case, the applicants do have an undue hardship that is unique to the property,
The abutting property on the south is a driveway of approximately 20 feet in width. This
driveway goes to a home west of the subject property. A home cannot be constructed
near the applicants' south property line and the home to the south of the applicant's
property is approximately 37 feet from the applicants' home. The reason for setbacks is
to keep a distance between homes, and with the 20-foot driveway between the
properties, the homes will be fmiher apati than if each of the homes had a 12- foot
sideyard setback,
. What was the discussion at the Zoning and Planning meeting?
Ms. Andcrson reviewed the proposed addition and the reason for the variance, Gary
and Tina Code appeared before the Commission, The Codes were asked about the
drive\vay, Mr. Code speculated that at one time one owner owned all of the lots and
kept the driveway at its CUITent location when the sUlTounding lots were sold. No one
appeared at the meeting regarding the variance.
Alternatives.
1. Approval the variance. By approving the variance, the applicant will be able to
construct the second story as proposed.
. ') Denial the variance, By denying the variance, the applicant will not be able to
construct the second story as proposed, If the City Council considers this altel11ativc,
findings of fact will have to be stated that support this recolllmendation,

3. Continue for further infonnation. If the City Council indicates tllat further
infonnation is needed, the item should be continued.

APPROVING A VARIANCE FOR A SmE YARD SETBACK
WHEREAS, an application for Varlance VN04-3 has been made by Christina and Gary
Code; and
WHEREAS, thc procedural history of the application is as follows:
l. That an application for Variance VN04-J was madc by Christina and Gary
Code on April 7, 2004;
2, That the Hopkins Zoning and Planning Commission, pursuant to mailed
noti ce, he Ie! a mceting on the app lication and reviewed such appl ication on
April 27, 2004: all persons present were given an opportunity to be heard;
3. That the 'vvrittcn comments and analysis of the City staff were considered;
and
4. Legal description of the parcel is as follows:
Lot 23 and 24, Block 12, F.A. Savage's lnterlachen Park
. NOW, THEREFORE, BE IT RESOLVED that application for Variance VNCl4-3 is
hereby approved based on the following Findings of Fact:
I. That the subject property has a unlque circumstance because of the driveway
on the south side of the property
