CR 04-169 Ordinance Extending Moratorium . October 19,2004 Council Report 2004-169 ORDINANCE EXTENDING MORATORIUM Proposed Action Staff recommends adoption ofthe following motion: Approve Ordinance 2004-935 extending the term of the moratorium on the issuance of any new licenses for transient merchants. This action will give the City Council additional time to examine tl1e appropriate zoning and regulations for transient merchants. Overview The Hopkins City Council adopted a moratorium on the issuance of transient merchant licenses in April. The City of Hopkins has an ordinance, Section 1145 of the City Code, which regulates peddlers, solicitors and transient merchants. Staff believes that the current ordinance needs significant revision. One of the m::Dor issues that the current ordinance does not address is where transient merchants are allowed. CUITently almost any private property may host a transient merchant. Certainly the City would want to look at restricting these merchants to certain zoning districts. Other issues that need to be . examined include the size of any tent or other temporary structure, how long such an activity can operate, and any other regulations that will protect the health and safety of Hopkins' residents. The City is still in the process of completing its study. The Zoning and Planning Commission will be considering the zoning issues at its October 2004 meeting. The City Clerk is in the process of preparing regulatory language for review by the City Council. Primary Issues to Consider . How long will the moratorium last? The moratorium is set to expire on April 19,2005. If the study is completed before then, the moratorium can be ended earlier through the adoption of an ordinance. Supportin2: Information . CITY OF HOPKINS HENNEPIN COUNTY, MINNESOTA ORDINANCE NO 2004-935 AN ORDINANCE EXTENDING THE MORATORIUM ON THE ISSUANCE OF ANY NEW LICENSES FOR TRANSIENT MERCHANTS ESTABLISHED BY ORDINANCE NO. 2004-922 THE CITY COUNCIL OF THE CITY OF HOPKINS ORDAINS: Section 1. Findings. 1.01 By Ordinance 2004-922, the City Council placed a moratorium on the issuance of any new licenses for transient merchants pending completion of a study and the adoption of any amendments to the City's ordinances. The ordinance is scheduled to expire on October 26,2004. 1.02 The City is still in the process of completing its study. The Zoning and Plmming Commission will be considering the zoning issues at its October 2004 meeting. The City Clerk is in the process of preparing regulatory language for review by the City Council. 1.03 It is necessary for the City Council to extend the moratorium in order to allow the . plaIming process to be completed. Sec. 2. Extension of Moratorium. The moratorium on the issuance of any new licenses for transient merchants established by Ordinance No. 2004-922 is extended until April 19, 2005, or such earlier date as may be further adopted by ordinance. All other provisions of Ordinance No. 2004-922 remain in effect. Sec. 3. This ordinance shall be effective the day of its publication.
