Approve Easement and Construction Permit with Hennepin County
CSAH 73/5 Intersection Improvement project
Proposed Action.
Staff recommends adoption of the following motion: Move that Council approve
a hiqhway, drainaqe and wetland conservation easement; and construction
permit between the City of Hopkins and Hennepin County and authorize the
Mayor and City Manaqer to siqn on behalf of the City.
Overview.
The City of Hopkins owns parcel no. 19 in the NW quadrant area of the Hopkins
Crossroads/Minnetonka Boulevard intersection. In order to accommodate the
roadway improvements, a temporary construction easement and a permanent
highway and permanent wetland conservation easement are required. The
permanent highway easement is a narrow strip of land along the west side of
Hopkins Crossroads north of the intersection with Minnetonka Boulevard - a total
. of 4,523 SF. The conservation easement is floodplain fill mitigation area and is
located within the Hopkins Public Works storage yard area and adjacent to
Minnehaha Creek - a total of 4,128 SF. A small drainage easement is also
required to accommodate a culvert pipe under Minnetonka Blvd, just west of
Robinwood Lane. The construction permit allows temporary construction
disturbance on 25,324 SF of city property adjacent to the roadway and along the
access drive to the PW storage yard. This property will be restored to its present
condition at the completion of the project. Staff recommends approval.

Grantor, hereby conveys and quitclaims to the COUNTY OF HENNEPIN, Grantee, a body
politic and corporate under the laws of the State of Minnesota, real property in Hennepin
County, Minnesota, together with all hereditaments and appurtenances belonging thereto_ The
real property is described on the reverse side of this document.
Grantor hereby releases Grantee from all claims for any damages resulting to the real
property described, by reason of the location, grading, construction, maintenance, and use of a
public highway, and the removal of materials from the real property conveyed, and from the
uses incident thereto, and the Grantee shall have the right to use and remove all earth and
other malerials lying within the parcel of land hereby conveyed.

Grantors, of Hennepin County, for valuable consideration hereby grant to the County of
Hennepin for a period of time terminating July 31, 2006, a Temporary Construction Permit, as part of
the general plan of improvement and protection of County Highway No.5 on the following described
property in the County of Hennepin, in the State of Minnesota.
As indicated on attached sketch and shaded in green.
It is mutually understood and agreed that the aforesaid consideration includes payment of
damages for and permits removal or destruction of grass or other herbage and other appurtenances on
. the above described premises. The County will seed or sod the disturbed area and otherwise restore it to
its present condition.
That the Grantor is the owner and in possession of the above-described premises, and has lawful
right and authority to convey and grant the permit herein granted.
