CR 04-161 Public Hearing . September 30, 2004 ~ Council Report 2004-161 Public Hearing Adopt Assessment Roll 2004 Miscellaneous Special Assessments Proposed Action. Staff recommends adoption of the following motion: Move that Council adopt Resolution 2004- 078, Resolution for Adoption of Assessment Roll. 2004 Miscellaneous Special Assessments. Overview. ..- The proposed special assessments as described in Exhibit A are for delinquent utility bills, citations, and invoices. Notices of this hearing have been published, and both notices and assessment statements have been mailed to all affected property owners. Primary Issues to Consider. . Assessment items . Property owners who have paid their proposed assessment between the time of notification and the Assessment Hearing date have been deleted from the assessment roll. . Appeal process If residents have not waived their rights to appeal, they are given the opportunity to approach Council during the public hearing. Standard appeal forms have been available at City Hall and need to be submitted no later than the public assessment hearing date. . Owner appeals/staff recommendations To date, our office has received four appeals. 1. P.I.D. #20-117-21 320026, 1 Hawthorne Road - Appeal #1 is a request for a revision of the assessment for a delinquent invoice for tree removal. The property owner is appealing the tenn of the assessment. Having this placed on his property taxes as a one-year payable would be a financial hardship for him. He would like to have the assessment spread over a 4 or 5-year period. He is not disputing the amount of the e assessment. City policy has been to certify delinquent invoices for tree removals to be payable in one year. Whereas, street and alley projects with similar or even smaller assessment amounts are spread over a 10-year period. Staff has been in contact with the City Attorney regarding this issue. City policy could be revised to allow a longer term for all delinquent invoices for tree removals. For example, an invoice for tree removal exceeding $1,000 would be spread over a 4-year term. Options are as follows: a. Adopt the assessment as it appears on the assessment roll as a one-year payable; or b. City policy can be revised to allow all delinquent invoices for tree removals, over a specified amount, to be paid over a longer period of time. Extending the period for paying the assessment for tree removal may have some unintended consequences. Homeowners are only assessed for the removal of trees on their property when the City has gotten involved with the tree removal. Homeowners who have promptly taken steps to hire a contractor and have their diseased tree(s) removed could not benefit from this policy change. The City would likely not want to get involved with lending residents money to pay to have their trees removed. . . Council Report 2004-161 Page Three If the City establishes a policy allowing several years to payoff the assessment for tree removal, will this encourage more residents to not hire their own contractor? Since a homeowner who hires a contractor to remove their tree(s) would have to pay the bill immediately, there may be incentive to delay tree removal until the City is forced to step in and arrange for the removal. This would have the effect of prolonging the time that diseased trees are left standing and increasing the amount of administration, performed by the City, that would be required for tree removal. On the other hand, there are additional costs incurred by the property owner by having the costs of tree removal placed on the property taxes as an assessment. For example, a $1,000 assessment would cost the homeowner over $250.00 over four years. A $2,000 assessment would cost the homeowner $445.00 in added charges. These costs would act as a disincentive to having the tree removal costs assessed. 2. P.LD. #24-117-22220057,406 14th Avenue N - Appeal #2 is a request for a revision . of the assessment for a delinquent utility bill and a delinquent invoice for tree removal citing that she has filed for bankruptcy and bankruptcy has been granted. According to the appeal, Mr. Taylor, the former spouse, has been made legally responsible for these bills through the Hennepin County Courts. Elizabeth Hayes wants the statements of assessments sent to Mr. Taylor. Staff is required by law to notify all owners of record of special assessments against their property. Hennepin County shows Elizabeth R Hayes as the owner of record for the affected property and the assessment statement was mailed to her. Please note that Ms. Hayes changed her name to Taylor since her purchase of the property. Mr. Taylor is not listed as an owner of the property. Because the assessment is against the property and not the individual, bankruptcy does not nullify the assessment. 3. P.I.D. #25-117-22 310498,709 11th Avenue S #6 - Appeal #3 is a request for cancellation of the assessment for two delinquent citations for failure to license a rental dwelling. The property owner appeared in Hennepin County Court on 9/23/04 for this violation, agreed to plead guilty and pay the fine of $50.00 if the assessment was waived. Staff was in contact with the City Attorney. The "assessment waived" is referring to the Hennepin County District Court assessment fee for her court appearance for the criminal charges. This has no bearing on the City of Hopkins Administrative . Citations. _u___ . Council Report 2004-161 Page Four 4. CITY OF HOPKINS Hennepin County, Minnesota NOTICE OF ASSESSMENT HEARING NOTICE IS HEREBY GIVEN that the City Council of Hopkins, Minnesota, will meet in the Council Chambers ofthe Hopkins City Hall, 1010 1st Street South, Hopkins, Minnesota at 7:30 p.m. on Tuesday, October 5,2004, to pass upon the proposed special assessments for the costs of delinquent utility bills, for delinquent invoices, and for delinquent citations. Please see the enclosed Statement of Assessment for your property. Except for petitioners who have waived their right to notice or obj ection, all persons who wish to be heard, or to object with reference to this matter may present their cases at this hearing either orally or in writing. No appeal may be taken as to the amount of any assessment adopted unless a written objection signed by the property owner is filed with the Special Assessment Clerk prior to the assessment hearing or presented to the presiding officer at the hearing. Even though appeals are due by the hearing date on October 5, 2004, the City Clerk strongly recommends that appeals be submitted to the Special Assessment Clerk's office by October 1, 2004. Appeal forms will be available at the assessment hearing or at the Special Assessment . Clerk's office at the Hopkins City Hall, 1010 1 st Street South, Hopkins, Minnesota. An owner may appeal an assessment to district court pursuant to MSA Section 429.081 by serving notice of the appeal upon the Mayor or City Clerk of the City of Hopkins within thirty (30) days after the adoption of the assessment and by filing such notice with the district court within ten (10) days after service upon the Mayor and City Clerk. Under provisions of Minnesota Statutes Section 435.193 to 435.195 the City may, at its discretion, defer the payment of assessments for any homestead property owned by a person 65 years of age or older for whom it would be a hardship to make the payments. The procedures to apply for such deferment are available from the Special Assessment Clerk Deferment applications should be submitted to the Special Assessment Clerk by October 1,2004. The following information shall also apply: 1. The property owner shall have the right to prepay the entire assessment. Your assessment may be paid without interest from October 5, 2004 to November 4, 2004, to the Special Assessment Clerk at City Hall, 1010 1st Street South, Hopkins, Minnesota. You may at any time thereafter and prior to November 30, 2004 pay to the Special Assessment Clerk the entire amount of the assessment remaining unpaid, with interest accrued from October 5,2004 to the date in which such payment is made. Such payment must be made prior to November 30, 2004 or interest will be charged through December 31 of the succeeding year. . . 2. Partial prepayment of the assessment in excess of 25 percent of the total assessment has been authorized by ordinance. A partial prepayment can only be made prior to November 30, 2004 with interest accrued to the payment date, except that no interest shall be charged on said partial payment if such partial payment is made by November 4, 2004. 3. m the case where accrued interest applies, the rate of interest to be accrued, if the assessment is not prepaid within the required time period, is proposed to be 7 percent commencing on the date of adoption by the City Council. Assessments shall be payable in one annual installment. 4. The amount to be specially assessed against your property is shown on the enclosed Statement of Assessment. 5. A $50.00 service charge has been added to the amount to be assessed for all delinquent bills. This is an important hearing because this is your last opportunity to be heard on the matter of this assessment, which affects your property. INFORMATION ON SPECIAL ASSESSMENTS HOW ARE SPECIAL ASSESSMENTS PAID? l. If the assessment is not paid prior to November 30, 2004, it will automatically be included with the real estate taxes payable in 2005. The actual terms of financing are set by the City Council at the Public Hearing. The interest rate is proposed to be 7%. 2. The assessment can be paid offin full or in part (at least 25%) to avoid the interest charges or to keep them as low as possible, the procedure and deadline for payments will be as follows: October 5.2004 to November 4.2004 (assumim! adoption on October 5.2004) - 30 day interest free. - During this period, the owner may pay all or part of the total, interest free. - Partial payments must be at least 25% of the assessment. November 5. 2004 throu2:h November 29. 2004 - interest accrues from date of adoption. - After the 30-day period, the total may be paid with interest prorated from the date of adoption to the date of payment, until November 29,2004. - Partial payments of at least 25% are still accepted, although interest charges will apply to the payment. November 30. 2004 - assessments are certified to Hennepin County. - Payments can no longer accepted by the City of Hopkins. . - On November 30,2004, the assessment is certified to Hennepin County for collection with the property taxes payable in 2005. - 15 months of interest is added to the miscellaneous assessments certified to the property taxes payable in 2005. CITY OF HOPKINS HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 2004-078 ADOPTION OF THE ASSESSMENT ROLL 2004 MISCELLANEOUS SPECIAL ASSESSMENTS WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for delinquent utility bills, citations, and delinquent invoices, all as more fully set forth and described in Exhibit A as attached to this resolution, and has amended such proposed assessment as it deems just, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HOPKINS, MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. . 2. Such assessments shall be payable in equal, annual installments extending over the periods of years set forth in Exhibit A, the first of the installments to be payable on or after the first Monday in January of2005. Any deferred installments shall bear interest at the rate set forth in said Exhibit A from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from October 5,2004, until December 31, 2005. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification ofthe assessment to the county auditor, pay the whole or a partial payment of at least 25% of the assessment on such property, with interest accmed to the date of payment, to the city treasurer, except that no interest shan be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and he may, at any time thereafter, pay to the city treasurer the entire amount of the assessment remaining unpaid, with interest accmed to December 31 ofthe year in which such payment is made. Such payment must be made prior to November 15 or interest will be charged through December 31 of the next succeeding year. 4. The clerk shall forthwith transmit a certified duplicate of this assessment to the county auditor to be extended on the property tax lists of the county. It is hereby declared to be the intention of the Council to reimburse itself in the future for the portion of the cost of this improvement paid for from municipal funds by levying additional assessments, on notice and hearing as provided for the assessments herein made, upon any properties abutting on the improvement but not made, upon any properties abutting on the improvement but not herein assessed for the improvement, when changed conditions relating to such properties make such assessment feasible. 6. To the extent that this improvement benefits nonabutting properties which may be served by the improvement when one or more later extensions or improvements are made, but which are not herein assessed, therefore, it is hereby declared to be the intention of the Council, as authorized by Milmesota Statutes Section 420.051, to reimburse the City by adding any portion of the cost so paid to the assessments levied for any of such later extension or improvements. 7.
