Staff recommends adoption of the following motion: Move that Council adopt Resolution 2004-081 , Resolution Orderinq the preparation of a feasibility report for year 2005 street improvements. Overview. The amended 2005-2009 CIP includes 2005 street improvements for Madison Avenue North, Madison Circle, Monroe Ave N, Jackson Ave N, Van Buren Ave N, Shadyside Circle and Sunnyside Lane. The first step in proceeding with a 2005 project is ordering a feasibility report. Staff has selected a qualified consultant to undertake topographic survey work, geotechnical evaluation and the preliminary engineering report. The cost of these services is $43,200. Final design and construction oversight services will be negotiated separately after the feasibility report phase and Council's ordering of the improvement project. e Primary Issues to Consider. . Council Report 2004-167 Page 2 Analvsis of Issues . Project background These streets were selected for 2005 improvements in light of their current pavement and curb/gutter condition. The pavement condition indices for these streets vary from 10 - 53, poor to fair. It's expected that improvements will cover the spectrum of partial reconstruction (retaining the current curb/gutter sections that are in good condition) to full reconstruction. The total project cost estimate is $1,000,000 . Selection of consultant/proposed fees Staff solicited a proposal from Bolton & Menk, Inc. This consulting firm has satisfactorily completed several city street improvement projects, has experience developing a preliminary assessment roll in Hopkins, knows city staff, has always submitted competitive bids and has shown themselves to be responsive to both city staff and Hopkins residents. Staff believes the value of a quality consultant with . considerable Hopkins experience and a proven track record is especially important for this project, while the City is without an Assistant City Engineer on staff. The proposed fee of $43,200 compares favorably with our historic expected cost for topographic survey and feasibility report for an improvement project of this size. The cost for the 2002 survey and report prepared for the 5th Avenue N project was $37,000. However, this 2005 report will include preparing a preliminary assessment roll and the survey work is more labor intensive due to the number of streets and elevation differences in the project area. . CITY OF HOPKINS HENNEPIN COUNTY, MINNESOTA RESOLUTION 2004-081 RESOLUTION ORDERING THE PREPARATION OF A FEASIBILITY REPORT FOR THE YEAR 2005 STREET IMPROVEMENTS WHEREAS, the following streets are in need of rehabilitation: Monroe Avenue North; Madison Avenue North; Madison Circle; Jackson Avenue North, north of 2nd Street NE; Van Buren Avenue North, between 2nd Street NE and Shadyside Circle; Shadyside Circle; Sunnyside Lane. WHEREAS, City staff is requesting that these streets be upgraded under the City's assessment policy even though no petition for the upgrade has been submitted; and WHEREAS, the first step in the assessment procedure is the ordering of a feasibility report. NOW THEREFORE BE IT RESOLVED, by the City Council of the City of . Hopkins, Minnesota, that the proposed improvements be referred to the firm of Bolton and Menk, Inc. for study and that they be instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is feasible and as to whether it should best be made as proposed or in connection with some other improvement, and the estimated cost of the improvement as recommended. The CLIENT shall promptly compensate the CONSULTANT in accordance with Section III of this Agreement. B. The CLIENT shall place any and alL previously acquired inionnation in its custody at the disposal of the CONSULTANT for its use. Such infonnation shall include but shall not be limited to boundary surveys, topographic surveys, preliminary sketch plan layouts, building plans, soil smveys, abstracts. deed descriptions, tile maps and layouts, aerial photos, utility agreements, environmental reviews, and zoning limitations. The CONSULT ANT may rely upon the accuracy and sufficiency of all such information in pcJfonning services. C. The CLIENT will b'llarantee access to and make all provisions for entry upon both public and private portions of the project and peninent adjoining propcliies. D. The CLIENT will give prompt notice to the CONSULTANT whenever the CLlE~T observes or otherwise becomes aware of any defect in the proposed proj eel. E. The CLIENT shall designate a liaison person to act as the CLIENT'S representative with respect to services to be rendered under this Agreement. Said representative shall have the authority to transmit instnlCtions, receive instructions, receive infonnation, inlel pret and defmc the CLIENT'S policies with . respect to the project and CONSULTANT'S services. F. The CLIENT shall provide such legal, accounting, independent cost estimating and insurance counselling services as may be required for completion of the consultant services described in this agreement. G. The CLIENT will obtain any and all regulatorypennits required for the proper and legal execution of the project. H. The CLIENT will hire, when requested by the CONSULTANT, an independent test company to perfonl1 laboratOlY and material testing services, and soil investigation that can be justitied for the proper design and construction of the proj eel. In addition to the foregoing, CONSULTANT shall be reimbursed at cost plus an overhead fee (not-to-exceed 10%) for the following Direct Expenses when incurred in the pet{onnance of the work. a. Client approved outside professional and tcc1mical services. b. Outside reproduction and reprographic charges. c. Other accc-ptable costs for such mlditional items and services as may be required by the CLIENT to fulfill the tenns of this Agreement. 4. Additional services as outlined in Section I.B will vary depending upon proj ect conditions and will . be billed on an hourly basis at the rate described in Section IIlkl - B. STANDARD OF CARE Professional services provided under this Agreement will be conducted in a manner consistent with that level of care and skill ordinarily exercised by members of the Consultant's profession currently practicing under similar conditions. No warranty, express or implied, is made. B. CHANGE IN PROJECT SCOPE. In the event thc CLIENT changes or is required to change the scope of the project from that described in Section I and/or the applicable addendum, and such changes require Additional Services by the CONSULTANT, the CONSULTANT shall be entitled to additional compe.nsation at the applicable hourly rates. The CONSULTANT s}lall give notice to the CLIENT of any Additional Services, prior to furnishing such additional services. The CLIENT may request an estimate of additional cost horn the CONSUL TANT, and the CONSULT ANT shall 1111'nish such, plior to authorizing the chal1gcu scope of work. e. LlMITATION OF LIABILITY. . COKSULT ANT shall indenmify, defend, and hold harmless CLIENT and its officials, agents and employees from any loss, claim, liability, and expense (including reasonable llttomeys' fees and expenses of litigation) arising fi"om, or based in the whole, or in any part, on any negligence act or omission by CONSULTANT'S employees, agents, or subconsultants. Tn no event shall CLIENT be liable to CONSULTANT for consequential, incidental, indirect, special, or punitive damages. CLIENT shall indemnify, defend, and hold harmless CONSULTANT ami its employees ham any loss, claim, liability, and expense (including reasonable attorneys' fees and expenses of litigation) arising from, or based in the whole, or in any part, on any negligence act or omission by CLIENT'S employees, agents, or consultants. In no eVl.::nt shall CONSULTANT be liable to CLIENT for consequential, incidental, indirect, special, or punitive damages. II is agreed that the CONSULT ANT and its representatives shall not be responsible for the: menllS, methods, techniques, schedules or procedures of construction selected by the contractor or the safety precautions or programs incident to the work of the contractor. E. INSURANCE. The CONSlK.TANT agrees to maintain, at the CONSULTANT'S expense, st8tutory worker's compensation coverage. The CONSULTANT also agrees to maintain such general liability insurance for claims arising for bodily injury, death or property damage which may arise from the negligent performance by the CONSULTANT or its employees of its day~to-day general business activities (such as automobile use) and exclusive ofthe perfol1118nce ofthe professional services described in this Agreement F. REUSE OF DOCUMENTS. All documents including Drawings and Specifications prepared or furnished by CONSULT ANT pursuant to this Agreement are instruments of service in respect of the Project and CONSULTANT shall retain exclusive ownership and property interest therein whether or not the Project is completed. The CONSULTANT shall be deemed the author of these docmnents and shall retain all COllunon law, statutory and other reserved rights including the copyright. CLIENT may make and retain copies for in[onnation . and reference in connection with the use and occupancy of the Project by CLlENT and others; however, such documents are not intended or represented to be suitable for reuse by CLIENT or others on extensions of the Project or on any other project. Any reuse without wlitten verification or adaptation by CONSULT ANT for the specific purpose intended will be at CLlENT'S sole risk and without liability or legal exposure to CONSULTANT and CLIENT shall indemnify, defend lli1d hold hmmless CONSULTANT from all claims, damages, losses and expenses including aLtomey's fees arising out of or resulting therefrom. Any such verification or adaptation will entitle CONSULTANT to further compensation at rates to be agreed upon by CLIENT and CONSULTANT. G. OPINIONS OR ESTIMATES OF CONSTRUCTION COST. Where provided by the CONSULTANT as part of Exhibit I or otherwise, opinions or estimates of construction cost will generally be based upon public construction cost infonnation. Since the CONSUL T ANT has no control over the cost oflabor, ll1ateria1s, competitive bidding process, weather conditions and other factors affecting the cost of constlUction, all cost estimates are opinions for general infonnation of the CLlENT amI no warranty or guarantee as to tht: accuracy of construction cost opinions or estimates is made. The CLIENT agrees that costs for project financing shall be based upon actual, competitive bid prices with reasonable contingencies. . PAYMENTS_ If CLIENT fails to make any payment due CONSULTANT for sClvices and expenses within thilty days after date of the CONSULT ANT'S invoice, a service charge of one and ol1c-halfpercent (1.5%) per month or the maximum rate permitted by law, whichever is less, will be charged on any unpaid balancl;;. In addition, CONSULTANT may, after giving seven days' written notice to CLIENT, suspend selvices under this A6'1'eement until CONSULTANT has been paid in fun all amounts due for scrvice:~, expenses and charges. I. TERMINATION. K_ NON-DISCRlMINA TION. The provisions of any applicable law or ordinance relating to civil rights and discrimination shall be considered part of this Agreement as if fully set fOlth herein. EXHIBIT I TOPOGRAPHiC SURVEY A:-JD fEASIBILITY STUDY 2005 STREET AND UTILITY IMPROVEMENTS CITY OF HOPKINS, MIKNESOT A A. BASIC SERVICES In accordance with the City of Hopkins amended 2005 Capital Improvements Plan, the City has desi,gnated the following streets for rehabilitation in 2005: 1. Monroe A venue North 2. Madison A venue North 3. Madison Circle 4. Jackson Avenue North. north of2m\ Street NE 5. Van Bmen Avenue N~rth, between 2nd Street NE and Shadysidr Circle 6. Shadyside Circle 7. Sunnyside Lane Based on a preliminary review of the project area, we estimate that the constnlction costs . for these improvements will be between $1.0M and $1.2M. This estimate appears consistent with those street and utility estimates itemized in the City's err. Bolton & Menk, Inc. will complete a topographic survey and feasibility study for proposed improvements within the project area. A description of our proposed services is detailed as follows: Task 1: Topographic Survey and Mapping Bolton & Menk, Inc. will complete a topographic survey of the existing conditions along each of the project corridors. The survey will be completed within the rights-of-way of each corridor and will include all visible features such as, but not limited to, pavements, curb lines, manholes, catch basins, valves, sidewalks, turf areas, driveway~;, power poles, trees, gardens, mailboxes, retaining walls, etc. All underground utility information will be located and described per available as-builts, field markings, and private utility map information. Manhole reports will also be completed for located manholes and catch basins. Right-of-way will be illustrated based on found field monumentation and plat information received fi"om the City. Task 2: Feasibility Study and Report The preparation of the feasibility study will include the assembly of existing infonnation fi:om the City of Hopkins and review meetings with City staff to discuss the existing street and utility conditions and needs for improvements. This task will also include preliminary engineering and design of the proposed improvements, a review and . discussion of the final geotechnical report, a neighborhood meeting, and two City Council meetings. Bolton & Menk, Inc. will collect all available information relating to the project and adjacent areas from the City of Hopkins including street and utility as-builts, pavement maintenance reports, sewer videos and logs, utility maintenance rep011s, and streetlight wiring diagrams. The review ofthe existing utilities win be initiated hy a meeting with the City of Hopkins engineering and public works staff. The purpose of thi s meeting is to receIve input from the City's staff regarding their OplTIlOnS of any necessm'y improvements. We will also prepare a neighborhood survey fonn for distribution by the City and will review the results of the SlU"veys for discussion at the neighborhood meeting and for inclusion in the feasibility report where applicable. The geotechnical rfllOlt prepared during Task 3 will serve as the basis of our pavement evaluation. The evaluations, analyses, and recommendations of this report will be summarized for inclusion into the final feasibility study. Bolton & Menk, Inc. will prepare itemized cost estimates for the proposed improvements throughout the proj eet area and will utilize these estimates along with plat information to prepare a preliminary assessment roll for the project. The results of the feasibility study including descriptions of the existing infrastructure, proposed improvements, estimated costs, preliminalY assessment roll, and proposed project schedule will be detailed in a written report and presented at a neighhorhood . meeting and at a City Council meeting. We will also attend a second City Council meeting for the purpose of holding a Public Hearing. Task 3: Geotechnical Evaluation Bolton & Mertle, Inc. will retain Braun Intcrtec Corporation to complete the geotechnical requirements of this project. These requirements include an evaluation of the existing subgrade soils and pavements, auger borings to sample the underlying soil cOl1lJitions, and pavement rehabilitation recommendations. The final product of this task will be a completed geotechnical report summanzmg the evaluations, analyses, and recommendations. Auger borings will be completed at locations and depths as illustrated in thc attached sketch. The purpose of these borings is to assist in the analysis of the existing pavement sections and subgrades, and to provide soils information within the zones of possible utility improvements. Upon (.;ompletion of the auger borings, the in-place subgrade soils will be categorized and evaluated to determine estimated R-values indicating sub grade strength. This infOlmation will be considered along with City-furnished PCI values and visual field ohservations to determine cost-effective pavement rehabilitation techniqucs for the vmious roadways. .
