Dear Nancy:
My wife and I went to Davani's Pizza on Highway 7 where members of the Nine Mile Cove association had
agreed to meet me and discuss our office condo project at 7:30 yesterday evening. I had come prepared to
discuss any changes in landscaping or other ways that I could adjust the project to meet any concerns they might
have_
After we introduced ourselves, they made the following points:
1. They were v~ry opposed to our project.
2. They prefered to look at the trees on our property as opposed to a building.
3. That they had an attorney with whom they had consulted and felt that they could pursue avenues to delay and
ultimately prevent the project and that there were many members in their association who were all opposed to the
project.
4. That they felt that the Watershed was usually sympathetic to environmental concerns and that some of their
members had served on the Watershed and that it may be very difficult to obtain approvals from them.
5_ That one possible solution would be for them to buy the property.
6_ That there are probably other governmental agencies who's approval we would need and that they would
. oppose such approvals with them.
7. That other projects had been attempted on this property and had never come to fruition.
I replied as follows:
1. We didn't buy the property to sell it, we bought the property to build an office for our company, and that is what
we intend to do.
2. Before we bought the property, we inquired of the City as to whether the property was properly zoned for the
purpose we had in mind, and were told that it was_
3. As we have proceeded with our approval procedure, we have been working to satisfy govern metal
requirements and it is possible that we will become aware of more requirements as we proceed that we will also
work to satisfy.
4_ We understand that this is not an easy project and that there will be problems to overcome. We intend to make
our best efforts to overcome them and build a project that is a credit to the neighborhood and the community.
We regret that an opportunity was missed to make the project better for the Nine Mile Cove residents_ I
understand that they view the trees on our property as part of "their view". My preference would be to work with
them to preserve some of the trees rather than clearing all of them.

RESOLUTION NO: 04-65
RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING TO CONSTRUCT AN OFFICE BUILDING
WHEREAS, an application for Site Plan Review SPR04-1 has been made by Jim Parker;
WHEREAS, the procedural history of the application is as follows:
l. That an application for a site plan review was made by Jim Parker on July 30,
2004;
2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and
published notice, held a public hearing on the application and rcvie\ved such
application on August 31, 2004 and continued by the City Council on September
7,2004: all persons present were given an oPPOliunity to be heard;
3. That the written comments and analysis of City staff were considered; and
. 4. A legal description of the subject property is as fo]]ows:
Commencing on the east line of the nOliheast quarter of the soutl,east quarter at a
point 395.12 feet south from the northeast comer of the southeast quarter; thence
westerly at an angle of 87 degrees 29 minutes with said east line a distance of 400
feet to the point of beginning; thence continuing westerly on the extension of last
described line 179.8 feet; thence south parallel with the east line of said northeast
quarter of the southeast qumier a distance of 767 feet; thence east to a point on the
east line of said nOliheast quarter of the southeast quarter distant 1132.] feet south
from the northeast comer of said northeast quarter of the southeast quarter; thence
north along said east line 357 feet; thence westerly at an angle to the left of 92
degrees 31 minutes a distance of 400 feet; thence north to the point of beginning,
except roads, Section 25, Township 117, Range 22, Hennepin County, Minnesota.
NOW, THEREFORE, BE IT RESOLVED that the application for Site Plan Review SPR04-1
hereby approved based on the following Findings of Fact:
1. That the proposed development meets the requirements for site plan approval.
BE IT FURTHER RESOLVED that application for Site Plan Review S PR04-1 is hereby
approved based on the following conditions:
. 1. That the Watershed District approves the development.
2. That the final drainage, grading and utility plans are approved.
. 3. That the applicant submits a new landscape plan that would add increase the
number and size of trees on the west side of the parking area.
4. That the lighting in the parking area is directed down.
Adopted this 21 st day of September 2004.
