CR 2004-160 Approve Purchase Agreement Between City Of Hopkins And The Blake School (2) CITY OF . ~ HOPKINS September 17, 2004 Council Report 2004-160 Approve Purchase Agreement between City of Hopkins and The Blake School Proposed Action. Staff recommends adoption of the following motion: Move that Council approve a purchase aareement between the City of Hopkins and The Blake School transferrinq title to certain City-owned real property described therein. Overview. The County acquired a little less than an acre of property from The Blake School along Excelsior Boulevard in order to allow road reconstruction. In an effort to settle on the compensation for the County property taking and avoid condemnation proceedings, The Blake School has requested title to the 105' wide strip of city-owned property along the south end of the Blake School campus. The City has agreed to this property transfer provided all public uses of the land are protected by perpetual easements in favor of the City. A notice describing the proposed land transfer and announcing a Sept 13 public . informational meeting was mailed to all area Hopkins residents. Staff has not received any objections to the property transfer and none of the area residents attending the public meeting opposed the land transfer. The City Attorney has reviewed and approved the language in the purchase agreement and staff recommends approval. Primary Issues to Consider. . Agreement Terms and Conditions - The Blake School agrees to release and dismiss all claims related to Hennepin County condemnation proceedings - The City shall reserve and retain permanent easements for any underground public utilities located on the property, including a 40' wide easement for the 12" waterline and 20' easements for ufg storm sewer lines. - The City shall reserve and retain a 20' wide permanent public trail . easement, centered on the location of the existing public trail. Buyer shall grant a conservation easement to the City over all of - the property, requiring the property to be left in its natural condition. The conservation easement has the following exception: . At such time as Xhe Blake School acquires land to the south of the city property and has obtained approval for expansion of The Blake School campus to the land south of the city property, The Blake School shall be entitled to use portions of the acquired city property for landscaped areas, playing fields, underground utilities, sidewalks and one north-south access drive, but only as necessary to allow expansion of The Blake School campus. In no event shall The Blake School be entitled to use any part of the property for a parking lot or for an east-west driveway. With this executed purchase agreement, the total compensation to Blake School for the Excelsior Boulevard takings will be $350,000, one-half of which is paid by the City of Hopkins, and the property deeded per this purchase agreement. .
