Staff recommends the following motion: Move to adopt Resolution 04-69, approving the construction of a building that will be used for a Starbucks Coffee. At the Zoning and Planning meeting Mr. Paul moved and Mr. Aamess seconded a motion to adopt Resolution RZ04-31, recommending approval to construct a building that will be used for a Starbucks Coffee business. The motion was approved unanimously. Overview. Mathwig Development is proposing to constmct a Starbucks Coffee on the retail pad south of the f0l111er Hopkins House site. This site was re-platted and a B-3 pad was separated from the condo/townhouse site. The fanner Hopkins House site was approved for redevelopment to condo and townhomes by the City Council earlier this month. . The applicant has requested a conditional use permit for a drive-thTOugh. What is the zoning of the property, and how has the Comprehensive Plan designated the subject site? The subject property is zoned B-3, General Business. A restaurant is a pennitted use within the B-3 zoning district. The Comprehensive Plan has designated the site as CommerciaL The proposed use complies with both documents. . What aloe the specifics of the site plan? Exterior The exterior will be a combination of stucco and siding. There will also be a standing seam metal roof and canvas awnings. Landscaping The site is required to have nine trees. The plan as proposed indicates nine trees of the required size. There are also additional trees and shrubs on the right-of-way. The applicant will have to get pennission from the City for these plantings. In addition to the required trces . there, are additional shrubs and perelU1ials. Par-king The parking will be located on the north and south sides of the site. The site is required to have 10 parking spaces; the site will have 11 spaces plus three available to use at the Walgreens site. Engineering/Public Works The City Engineer is reviewing the plans. Any approval will be contingent on his approval. Fire Marshal The fire marshal has reviewed the preliminary plans and found them acceptable. Trash The trash area will be located on the north side of the site behind the building. The trash area will be enclosed as required. Sidewalk . There is a sidewalk along Robinwood Lane, and the sidewalk will remain. -- --. -- CR04-146 Page 3 . Access/Parking The entrance to the drive-through, will be from Robinwood Lane. Access to the parking will be from the drive-through area and the existing drive off of Robinwood Lane. Setbacks The following are the required and proposed setbacks: B-3 Proposed Front yard 20 feet 65 feet West side yard 10 feet 10 feet East side yard 10 feet I 0 feet Rear yard 25 feet 40 feet Building Height 45 feet 20 feet Watershed District The watershed district will have to approve this development. Sunounding uses . The site is sUlTounded by Highway 7 to the south, Brentwood to the east, former Hopkins House to the north, and Walgreens to the west. . \Vhat was the discussion at the Zoning and Planning meeting? Ms. Anderson reviewed the proposed building. Jack Boarman and Troy Mathwig, the architect and property owner, appeared before the Commission. Mr. Boarman stated that they wanted it to look like a continuous development. The manager of Caribou Coffee appeared at the public hearing, she was concemed with the parking and hmv it would negatively affect her business. Alternatives. 1. Approval the site plan to construct the building. By approving the building, the applicant will be able to constmct the building as proposed. ') Deny the site plan to constmct the building. By denying the construction of the building, the applicant will not be able to construct the building as proposed. If the City Council considers this alternative, findings will have to be identified that support this altemutive. 3. Continue for further information. RESOLUTION NO: 04-69 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING THE CONSTRUCTION OF A STARBUCKS COFFEE ON THE RETAIL PAD SOUTH OF THE FORMER HOPKINS HOUSE HOTEL WHEREAS, an application for a Site Plan Review, SPR04-3, has been made by Mathwig Development; WHEREAS, the procedural history of the application is as follows: l. That an application for a site plan review was made by Mathwig Development on July 30, 2004; 2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on August 31, 2004: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of City staff were considered; and 4. A legal description of the subject property is as follows: . Block 1, Lot 2, Crossroads Addition NOW, THEREFORE, BE IT RESOLVED that the application for Site Plan Review SPR04-3 is hereby approved based on the foJlowing Findings of Fact: 1. That the proposed development meets the requirements for a site plan review. BE IT FURTHER RESOLVED that application for Site Plan Review SPR04-3 is hereby approved based on the following conditions: 1. That the Watershed District approves the development. 2.
