February 18,2003 Council Report 2003-029 ORDINANCE AMENDING SECTION 1200 OF THE HOPKINS CITY CODE Proposed Action Staff recommends that the Council approve the following motion: Move to approve Ordinance 2003- 897 for first reading. Approval of this motion will begin the process of amending section 1200 of the Hopkins City Code to establish distance requirements for new off-sale liquor stores. Overview The moratorium on the issuance of any new off~sale liquor licenses is set to expire on FeblUary 25. 2003. During the moratOliulTI the City Council examined a number of issues in relation to off~sale liquor sales. The Council detennined that the interests of the City and its residents could best be served by establishing distance requirements that would separate off-sale liquor sales fi'ol11 sensitive uses such as schools and churches and would also prevent the concentration of such businesses as liquor stores. pawn shops, and adult Oliented services. . Hopkins City Code, Section 535.03, Subd. 2 CC #4 establishes the following conditional use requirement for religious institutions: "That there shall be no religious institution within 350 feet of an off sale or on sale liquor establishment." Should there be a difference between the B-2 and B-3 business areas? The proposed ordinance treats both business areas the same. Due to the density of the B-2 district, the proposed distance requirements would make it very difficult to locate another liquor store in the downtown area. Each Mainstreet block in the downtown area is approximately 300 feet in length. Alternatives 1. Approve Ordinance 2003-897 for first reading. 2. Do not approve Ordinance 2003-897 for first reading and direct staff to make changes. Staff recommends Altelllative # 1. . . . CITY OF HOPKINS Hennepin County, Minnesota ORDINANCE 2003-897 AN ORDINANCE AMENDING SECTION 1200 OF THE HOPKINS CITY CODE Whereas, the Hopkins City Council has determined that the interests of the City and its residents can best be served by establishing distance requirements that would separate off-sale liquor sales from sensitive uses such as schools and churches and; Whereas, the Hopkins City Council has determined that preventing" the concentration of such businesses as liquor stores, pawn shops, and adult oriented services would enhance the general welfare of the citizens; Now, therefore, the City Council of the City of Hopkins does hereby ordain: Section 1. Hopkins City Code, Section 1200.12 is hereby added to read as follows: 1200.12. No new off-sale license shall be granted for any building within 350 feet of any elementary or secondary school; daycare center; or religious institution. Furthermore, no new off-sale license shall be granted for any building within 350 feet of any existing liquor store, pawn shop, licensed currency exchange, or any business licensed under Section 1160 or 1165 of the Hopkins City Code (Adult businesses.) For purposes of this ordinance, this distance shall be a horizontal measurement from the nearest existing property line of any church site, school si te, day care site, or the site of any exist ing liquor store, pawn shop, licensed currency exchange, or any business licensed under Section 1160 or 1165 of the Hopkins City Code, to the nearest property line of the proposed off-sale liquor site. Section 2. The effective date of this ordinance shall be the date of publication.
