ORDINANCE AMENDING SECTION 1325
OF THE HOPKINS CITY CODE
Proposed Action
Staff recommends that the Council approve the following motion: Move to approve Ordinance 2003-
893 for first reading.
Approval of this motion will begin the process of amending section 1325 of the Hopkins City Code to
revise the definition of junk cars.
Overview
Section 1325.01 of the Hopkins City Code defines a "junk car." The proposed language expands this
definition in order to make the definition more objective.
Section 1325.03 sets out the time limits that various vehicles, including junk cars, can be parked on
public or private propelty. Tbis section is amended for purpose of making it clearer. It also changes a
two-hour time limit to a 24-hour time limit, which is more reasonable.

Why should these changes be made?
Section 1325.01 is being amended by adding the following items to the definition of a junk car:
· one or more flat or missing tires;
· one or more missing wheels;
· suppOlted on blocks, jacks or other similar SUPPOltS;
· one or more broken or missing windows;
· one or more missing doors;
· missing a hood or tnmk.
The purpose of these additions is simply to make it clearer what constitutes a junk car.
Section 1325.03 is heing amended to cImify this section. The cunent language, which the City has been
using for enforcement, states that you cannot park various vehicles for more than two hours for the
purpose of repair, replacement of pmis, maintenance, etc. This language would seem to allow an owner
to say: "I am not repairing the vehicle, I am just storing it." Noone ever made this argument, but staff
is suggesting that this be clarified.

Another change this is being suggested is that the two-hour limit be kept for vehicles under repair but
that time limit for vehicles that are just being parked be increased to 24 hours. A two-hour limit is
difficult to enforce. This ordinance is nonnal1y enforced against vehicles that have been illegally
parked for much longer than one day. Changing this time limit would also allow owners of racecars to
park them temporarily rather than have to stati them up late at night in order to place them in a garage.
Alternatives
1. Approve Ordinance 2003-893 for first reading.
2. Do not approve Ordinance 2003-893 for first reading and direct staff to make changes.

not operable; partially dismantled; used as a source of parts that are

any other maintenance work thereon, in or on any public street, alley,

permit the parking, keeping or storage for more than 24 hours of any
tractor, semi-trailer, racing or junk cars or other similar vehJocles, in
or on any public street, alley, road, highway, parking lot, park or ~her
