I City Clerk I CITY OF HOPKINS Memorandum To: Honorable Mayor and City Council Members Copy: From: Date: Subject: Terry Obermaier June 26, 2003 Ordinance 2003-906, regarding late bar closings' ~am~, Staff recommends the following action: move to approve Ordinance 2003-906 for second reading and order its publication and to adopt Resolution 2003-057, Resolution Setting Fees for Extended Bar Hours. At the first reading of Ordinance 2003-906, the City Council directed staff to add between 1 :00 a.m. and 2:00 a.m. on Friday and five holidays to subd 4. This change will allow bars to be open the extended hour on Thursday, Friday, and Saturday nights as well as the five holidays that were requested by the licensees. Resolution 2003-057 sets the fees for the extended hour. Those fees are set at: On-sale Liquor $1300 On-sale Wine $200 On-sale 3.2% Malt Liquor $150 The current fee for On-sale Liquor is $7500, for On-sale Wine is $800, for On-sale 3.2% Malt Liquor is $600. The fees listed above will be in addition to the current fees for alcoholic beverage licenses. They will only be assessed against those establishments that apply for and are approved for extended hours. The Ordinance and Resolution are attached. . . . ~Memo June 26, 2003 Page 2 CITY OF HOPKINS Hennepin County, Minnesota ORDINANCE 2003-906 AN ORDINANCE AMENDING SECTION 1200 OF THE HOPKINS CITY CODE Whereas, the State of Minnesota has adopted 2:00 a.m. closing time for on-sale liquor, wine, and 3.2 percent malt liquor, and; Whereas, the City of Hopkins excersises its authority to further limit the hours of sale in Section 1200 of the Hopkins City Code; The City Council of the City of Hopkins does hereby ordain as follows: Section 1: Section 1200.46 shall be amended as follows: 1200.46. Hours of operation. Subdivision 1. No sale of 3.2 percent malt liquor may be made between 1 :00 a.m. and 8:00 8:.m. on the days of Monday through Saturday, nor between 1 :00 a.m. and 12:00 noon on Sunday, except as stated in Section 1200.46, Subd. 4. Subd.2. Intoxicating liquor; on-sale. No sale of intoxicating liquor for consumption on the licensed premises may be made: (1) between 1 :00 a.m. and 8:00 a.m. on the days of Monday through Saturday; (2) after 1 :00 a.m. on Sundays, except as provided by section 1200.46, Subd. 3., except as stated in Section 1200.46, Subd. 4. Subd. 3. Intoxicating liquor; Sunday sales; on-sale. A licensee that holds a special Sunday on-sale intoxicating liquor license may sell intoxicating liquor for consumption on the premises in conjunction with the sale of food between the hours of 10:00 a.m. on Sundays and 1 :00 a.m. on Mondays, except as stated in Section 1200.46, Subd. 4. Subd.4. When a licensee has made application to the City of Hopkins and the Commissioner of Alcohol and Gambling for extended hours, and the application has been approved by the Hopkins City Council and the Commissioner of Alcohol and Gambling, and all fees have been paid to the City of Hopkins and the Commissioner s . Memo June 26, 2003 Page 3 of Alcohol and Gambling, said licensee may sell intoxicating liquor, wine, or 3.2 percent malt liquor between 1 :00 a.m. and 2:00 a.m. on Friday, Saturday and Sunday and the following holidays: 1. between 1 :00 a.m. and 2:00 a.m. on January 1 2. between 1 :00 a.m. and 2:00 a.m. November 1 3. between 1 :00 a.m. and 2:00 a.m. on March 18 4. between 1 :00 a.m. and 2:00 a.m. on December 24 6. between 1 :00 a.m. and 2:00 a.m. on Thanksgiving Day a). Fees for extended hours will be set from time to time in Chapter 10 of the Hopkins City Code by resolution. b). CITY OF HOPKINS HENNEPIN COUNTY, MINNESOTA RESOLUTION 2003-057 RESOLUTION SETTING FEES FOR EXTENDED BAR HOURS WHEREAS, Several businesses that are licensed to sell alcoholic beverages approached the City Council with the request to sell alcoholic beverages extended hours on certain nights, and; WHEREAS, The Hopkins Chief of Police has indicated that allowing the sale of alcoholic beverages until 2:00 a.m. will increase overtime in the Hopkins Police Department, which will cause an increase to wage expenditures, and; WHEREAS, The City Council has adopted an amendment to Section 1200.46 of the Hopkins City Code to allow businesses with licenses to sell alcoholic beverages to do so until 2:00 a.m. on certain nights if the increased cost to the Police Department is recovered by fees collected for so doing, and; WHEREAS, The ordinance allows the City to set fees for extended hours by resolution; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HOPKINS to set the following fees for extended hours of sale of alcoholic beverages: On-sale Alcohol On-sale Wine On-sale 3.2% Malt Liquor $1300 $200 $150 Approved by the City Council of the City of Hopkins on this 1 st day of July, 2003.
